Advice re. tax refund - UK

My DH receives a monthly military pension, which he pays tax on (always has and never changed it). He has been out of the UK for 7 years - would he be entitled to a tax refund on the tax he has paid on this.

Also does anyone know of an accountant who can help with UK tax issues.

If I can just add my tuppence worth here ... We're retired and live here in Dubai. We have no home or bank accounts back in the UK. We've also been non-resident having filled out the relevant form in 2005. But ... DH still has to pay UK tax on his pension because those monies were accrued under UK tax laws and part of this was AVC's (Additional Voluntary Conributions). There is no simple answer and everybody has a different situation. It really is best to phone HMRC and speak to somebody. We've had to do this several times because DH's tax code has been SO wrong. Just make sure that you have all the info at the ready - such as National Insurance Number and any other info such as the reference on your last tax return. It really helps if you have s k y p e or something similar as this helps keep the cost down.

Hi Lynn, he is definitely entitled to his cash. You are right, UK and UAE don't have a double taxation agreement -the reason being that the UAE doesn't pay tax anyway (countries like France, Germany etc do). You are best speaking to the tax office in Liverpool as they solely deal with offshore and foreign rebates, I have used this office when I lived in Germany and am using them again now I'm here. I'll root the number out for you tomorrow and message you back.

Thanks all - now i'm confused because DH called HMRC and they said no he wasn't entitled because UAE has no "double taxation treaty" with UK. We also completed the leaving UK paperwork about 6 years ago. Need to get back onto HMRC again.

My DH has two private pensions in the UK, paid into our bank account there, neither of which has been taxed since we left. On leaving four and a half years ago we filled in a 'Leaving the UK' form as we had no idea when we would be returning and we have only been back twice in all that time for a week each visit. We sold our house and business before we left. With our business, we were required to keep copies of our account for six years and they could be reviewed by HMRC at any time during that period of time. I wonder if this six year period also applies to repayment of tax ???? Everyone's circumstances are different and and the rules regarding residency and tax in the UK can be a bit vague. In fact they are in the process of reviewing them at the moment. I agree it is probably best to contact HMCR with your query.

My ex is Military and he claimed his tax back from his pension a year after he arrived here :-)

http://www.hmrc.gov.uk/cnr/p85.pdf You can call them they are really helpful I think anyone who is out of the UK for more than 1 tax year is entitled to a rebate. I got around 1000GBP so he may be on for a quite a bit more based on his mil pension edited by louisedvs on 25/10/2011 op this is not always the case with pensions.....my dh has a pension with a UK company yet it is taxed...they can tell you what the situation will be.

I agree, they helped me get 2 yrs worth of tax back! It was great, spent it all now though :( I do know a tax expert, Angeline, who helped out a friend of mine who was moving back to the UK - [email protected] HTH I blew mine in about 2 hours at DCC years ago haha
