School not refunding deposit due to new KHDA rules

I don't know if anyone else has encountered this, but a school that we put a 14,500 dhs deposit to is not refunding us now that we are withdrawing our child for the 2012/2013 school term. We have it in email correspondence that 14,000 dhs is refundable as long as we withdraw before August 1, 2012. Unfortunately for us, a few weeks ago KHDA instituted a new rule allowing schools to not refund the 30% term fee deposit unless you have extenuating circumstances. KHDA is allowing schools to use this new rule for the upcoming school year even though we are still in the middle of the school application/assessment process.

Does anyone know of a reputable lawyer that could help us fight this? Thanks.

Name and shame the school if you dont get your money back.

We had a similar situation though our deposit was AED500 and we decided not to send her back to the school a week after we paid. We were told by paying then withdrawing her we automatically cost another student a spot......what a load of bull!!!! They probably filled the spot the very next day. I hope you manage to get your deposit back GoBigBlue, some schools here are thieves

This is so wrong GoBigBlue, how dishonest of them. I hope things work out for you. Perhaps you should consider naming them if they continue to refuse the refund your entitled to. This would be a big red flag for me if I was ever thinking of moving my child to a school...

Hi, have you had any joy with this, we are just about to ask for a deposit refund and this is the first I realised there may be problems, when did these rules come in please?

I called the KHDA and I was asked to send an email to them. I still haven't received a reply so I'll try them again today. I always seem to have trouble communicating with them though. The language barrier is tough.

If it was before the new rules, then they cannot keep it. Perhaps you could speak directly to KHDA? Hopefully school will back down once they see you are prepared to take it as far as needed to get the money return

We gave the money well before the new rules. We never would have put down this deposit after the new rules. That's partly why we are so upset. The school never advised us that they were implementing these new rules. We plan on fighting this till the end. Like Bird replied, they will easily find another student to replace our child's spot, it's just extra money in their pockets.

We had the same issue 7 years ago. Not as much money but we never got it back. They easily got someone else for the place. It's just daylight robbery. There's no justification for keeping your money. Compounded my school choice!

If you joined the school after the 'new' rules came into effect then it will apply to your deposit. If you joined the school before the new rules came into effect then they are obliged to return your deposit. Do not back down. Lots of cheeky schools out there who bend and twist rules to their liking and you need to stand up for your rights.
