What notice period is stated in the contract for the tenant not to renew? It is usually either one month (which they have given you) or two months (which would already be covered by you keeping the security deposit). If no period is stated in the contract, I believe the legally recognised standard is 2 months (but you would need to confirm this with RC as I'm not 100%). I assume a new contract was never signed, in which case it will certainly not be worth your while pursuing this any further as you've not actually lost out on anything. And BTW, a 2-bed plus maid is classed as a 2-bed. I appreciate that this is a major limitation of the rental calculator but that still doesn't mean it should be classed as a 3-bed.

Reversing out of a space is seriously dangerous here due to the lack of basic common sense, courtesy and patience demonstrated by the vast majority of drivers in this country. If people actually stopped to let people reverse out of spaces, much less of us would reverse into them. But until that miracle happens I'll continue doing it the safest possible way for me and my family.

I am quite surprised that people fell for this twice...... I don't think anyone has fallen for it twice. I'd imagine those caught up in it this time either weren't even in Dubai two yars ago or simply didn't hear about the Marks Falcon or FHS scams. I wouldn't blame anyone for either scenario. Indeed, the only thing to blame here is a rental system that has allowed this to happen repeatedly over the last 10+ years and completely ineffectual regulations that make these agencies perfectly legal.

Don't worry about the DEWA threat (this was another common ploy from 2 years ago). If it is all in your name, there's nothing he can do about it.

I would go to the police and log it anyway as the police do not usually contact the landlord but at least it is then on record. The landlord might not of been in contact recently as they could be building a case against you at RERA or the Courts so I would protect yourself and maybe pay a visit to RERA to seek advice and find out what your rights are as the tenant in this situation. I agree. It can't do any harm to see where you stand. In the FHS/MF cases, the tenants were often turned away by the police because nothing criminal had actually happened to them. The onus was on the landlords to open the cases, but some of them built up very one-sided stories because the tenants weren't involved in the process at any stage. A common ploy was to deny all existence of an agreement between the landlord and the agent, claiming any contract must be fake. That's why it's important to have all the correct documentation to hand.

This happened to a friend of ours a couple of years ago with Shamyana Entertainment services. Over 400 people were scammed, everyone filed police reports but they did nothing and I doubt there is much they can do anyway. From what I remember RERA gave the tenants 1 or 2 months to vacate the property once the landlord filed a complaint as you have to remember the landlords were also scammed as they never received the rental cheque. Our friend did the most appropriate thing and shared the loss with the tenant, only 6 months rental amount was lost, my friend took a 3 month hit with losing rent and so did the tenant and I think this was the fairest way. My advice would be to contact the real landlord IF you can find their details and try to work it out mutually the fairest possible way. Shamyana was the 'tenant' and was illegally subletting to others without the knowledge of the owner. They weren't a RERA-approved agency, they didn't have title deeds, couldn't register with Ejari, and the duped tenants all agreed to keep DEWA in Shamyana's name. The "safeguards" in place here in Dubai are ridiculously porous, but the tenants caught up in that particular scam hadn't followed any of the established rental protocol, and for that reason had very little choice but to negotiate a mutually agreeable settlement with the real landlord. I sympathize with them completely, but it was the tenant that had been scammed, not the landlord. This Max Real Estate scam is identical to two others that blew up at the same time as Shamyana (and were much, much bigger) - Marks Falcon and FHS Properties. These were RERA-registered agencies that had fully legal sublet agreements in place with the owners. As such, they were able to provide title deeds, passport copies of the owners, contracts between landlord and agent, DEWA connections in tenant's name etc etc. In other words, everything was done above board and the tenants had followed all the correct procedures. In these cases, it was the landlord that had been scammed, not the tenant. My case didn't go to court as the landlord accepted it was his responsibility for willfully entering into an binding agreement with a fraudulent company. Lots of other cases did go to court, and most tenants were allowed to stay for the remainder of their contracts at no additional charge. If DEWA is in your name, you are Ejari registered, and have copies of the contract between the owner and MAX, the title deeds, and the owner's passport, you have nothing to worry about. There are numerous Facebook pages and websites about these two scams, so I urge those affected to Google them for further advice.
