I have just found out that my apartment has not yet sold so do I await instruction from the new LL if they buy before my contract is up? I would doubt it as anything could happen to the prospective purchaser. I would say that your contract has to be renewed with your current LL. The new buyer gets the apartment, tennant and all. Thanks Lets see what happens. They will be in for a shock when they try and increase the rent as although the rent calculator ( For the Views not the Greens) says an increase is due they didn't give me 90 days notice

Please excuse my ignorance but i am hoping someone could answer a couple of questions i have. Does removal of the two year rule only apply to new contracts? I guess what I'm asking is if we signed a contract June last year can the landlord now increase the rent on Renewal this year?or because we signed the contract before the new decree do we still get the two years? Second question is regarding the calculator - what is the definition of a complex? We live in a semi attached villa with a shared pool - would this be deemed a complex or an individual. There is only our villa and one other sharing the pool, two villas which are semi attached. No, everything is now under the RC

There is a slight increase as my building is classed as The Views not The Greens oops However it isn't a huge amount and cheaper than moving :-) but still as you are out of the 90 days, and you are getting evicted in a year, why would you pay? Do I have too? That I don't actually know? NO - unless they have told you in writing 90 days before the lease is up that there will be an increase / change in terms then it rolls over as before.... Is this written anywhere so I can send it to him? Thank you

Please can you give some reference to this, all the information on the decree has no reference? The only information I can find states: [i'>Decree No. 2 of 2011 (old), [b'>Decree, No. 43 of 2013 (new)[/b'> on rentals in the Emirate of Dubai, the landlords can increase the rent as below, RERA Calculator does this for you. A landlord must give a 90 day notice to his tenant if he plans to increase the rent, which has to be based on Real Estate Regulatory Agency’s (Rera) rent index. 5 per cent if the earlier rental is 11 to 20 per cent lower than the average rent for a similar property; 10 per cent if the rental is 21 to 30 per cent lower than the current going rates for properties of a similar scale; 15 per cent if the rent is as low as 31 to 40 per cent than comparable ones; and 20 per cent if a property’s rental is more than 40 per cent less than the average. [b'>Law (26) of 2007 – Article (9) Landlord should not increase such rent value or amend any of tenancy contract conditions until the elapse of two years from date of tenancy contract. Even after two years, if Rent Calculator shows no need of increase, then no need of increase. Only pay the within the market (RERA Calculator) price.[/b'> [/i'> I was under the impression the decree applied to the % increases and was not a change to Law regarding tenancy contract conditions. Was there another decree issued changing this? What other changes have they made to being able to change tenancy contract conditions? I'm sure something has been put in place to over rule Law (26) of 2007, the two year thing. Two year no longer applies

Hi Ladies. Our landlord has let us know that he wishes to change the terms to our rental contract. He now would like for us to pay all the consumption charges for chiller. Previously this charge was part of the landlords overall community charges however he now tells us it is a separate bill and he wants a deposit up front for this when we renew in the amount of 10000 and he will send us the bills quarterly. We stated that if the bill is in our name we will pay it but not otherwise. He knows he cannot increase our rent as per the rera calculator so I feel he is just throwing in this chiller consumption bill to get a rent increase under another name. His anyone else experienced this? Are we within our right s to say no if the bill is not in our name. And if a landlord wishes to change terms of contract how is he legally obliged to inform you? I can't find any info online. Thank you in advance. My colleague is going through the same dilemma My friends who do pay the chiller charges receive the bill from said companies and pay it themselves. They find anyway to screw us!

Hello Ladies - I'm looking for a bit of advice and help from some more experienced Dubai Mum's than me….. I'm starting to look into childcare for my little boy before I go back to work in June (he will be one) and wanted to know if it is possible to find part-time, live out Nannies here? I have found one nursery i really like but for 3 months he'd have to be part-time and I'd need someone to pick him and look after him in the afternoons and probably full-time for some of August. Does anyone have experience of agencies? Do any of the nannies drive? Is there any other way of doing? Maybe a student or British expat wanting work over the holidays? Any advice is welcomed. Thanks! Hello Agency is the only route however finding one that can drive may be difficult You could not hire a student or an Expat to do this as that would be illegal unfortunately and if anything went wrong then you could be heavily fined

I took one in this morning and it wasn't coloured and like Mavis's the landlords own format. Some typing centres insist on seeing the original so I try to take it plus a photocopy - just in case! I cant find the original anywhere whatsoever! I have all the other years but not this one Only a photocopy :-(

Aramex set you up with several addresses across the world and for a small fee you can have them sent here direct to your office address I use my Shop and Ship account a lot a Dubai shopping is pricey and you don't get the fabulous sales that the UK and US give. Shipping usually takes 5-7 days I'm not really up on kids shorts but try GAP

We were in a similar situation. Got asked to leave a few months before the end of the contract, no registered notarised notice ever came through. We logged a case at the rent committee. At the hearing the landlord came up with a new contract with different terms. The judge looked at it and we won the case. At the hearing, there were at least 10 people in a similar situation as us. The LL was asked to reimburse the RC 3.5% fee. Make sure you have everything documented and translated into arabic, and have faith in the legal process. The judge really has seen it all. It is a lot of hassle but less than finding a new more expensive place, paying the moving costs, agency fees etc Congratulations :-)

If you have a UAE licence, and a UAE residency visa you must use your UAE licence in UK otherwise your insurance is invalid (so it's not a case of relevant licence for each country). As I said, just giving a useful reminder as it seems to be a little known fact! You are correct and if you are using your UK licence at home and you have an accident the insurers will not pay out. This happened to a friend of mine 2 years ago The repair bill on the car was huge

I have been reading this forum and indeed other expat forums for the past couple of years and have lately been taking great interest in the whole landlord/rent increase debacle which is currently the hottest topic in Dubai! I thought I would add my two pennies to the discussion. d Our apartment ha been up for sale for about two years (a large local bank was the landlord). Needless to say, the bank didn't give us the requisite twelve month notice as they obviously wanted to hedge their bets and keep rent rolling in just in case the apartment didn't sell. In December, the apartment was eventually sold (to a neighbour in my building). The landlord and his wife visited and hinted that they would want us out and at the very least, would be expecting a 20,000dhs (40%) annual rent increase. DH and I both told them separately that this was illegal and that in order to evict us they had to give us 12 months' notice and that the eviction had to be based on one of four conditions. We also enlightened them about the rent calculator! Needless to say, all this fell on deaf ears and an eviction email was sent, giving us just over 100 days to get out. We refused to accept this notice and emailed back stating that any eviction had to be set out in accordance with Laws 26 and 33 (Landlords and Tenants must read both laws in tandem as Law 33 supercededs some of the clauses in Law 26) and that a formal notarised notice must be issued in the first instance. The landlord then got a notarised eviction notice issued (which is why we are convinced he thinks he is in the right, but it seems the Courts will notarise anything ergardless of its legality!) giving us another few months. We again emailed him back stating the laws and told him that as we had not been able to resolve this, we would be opening a formal dispute with the Rent Committee. DH and I both tried to ring the RC about 10 times each a day and eventually got through - it seems that business is not conducted by phone and it can be terribly frustrating trying to get through on the phone. I also gather that the RC will not deal with 'off the street' visitors with enquiries. Your only option is to submit a dispute. We had all our emails and his responses legally translated into Arabic and submitted these together with our lease (in Arabic and English), the EJARI, DEWA Bill, Passport and Visa and the formal application form (needs to be typed in Arabic - get this done at any of the Typing Centres near Union Square Metro Station - they don't open until at least 8.30am). Submitting the documentation was fairly straightforward as we double checked we had everything and at least three copies (in the end these weren't needed). We got to the Rent Committee Offices early (they close at 2pm). We had two issues though - the computer system was down and we therefore couldn't pay the fee (3.5% of the annual rent) and had to go back the following day. The acknowledgement was also incorrect (after I got an Arabic-reading friend to translate this) as it stated the wrong apartment number under dispute but another visit sorted this out. Everything is in Arabic so you have to trust that the Typing Centre fully understands your case and translates this accordingly. If they made a mistake, it will cost us time and efford to re-submit the documents and we will only find this out at the court hearing. This has all been a complete faff trying to get the documentation translated, taking three trips to the RC offices and the general stress of our landlord pushing us to accept the eviction. We have a hearing date in a couple of weeks and I gather that the proceedings will mostly be completed in English and should be over and done with in minutes as this is an open and shut case (according to the staff at the RC). The Judge's decision is final and there is no appeals process and the landlord will have to pay the 3.5% fee if he loses the case. The landlord has since sent us an email advising that IF a new lease is issued, that we will have to pay a rent increase. Of course, we emailed back and advised that we would accept an incease in accordance with the law (currently 10% in accordance with the calculator). I cannot work out whether my landlord is being naive or very cunning and calculated. He thinks that because he is a new landlord and has family circumstances which requires him to move his family into our apartment - aside from the fact that he is being kicked out of his apartment without the due notice from his landlord - that he will win the case. DH told him that the Judge will make his decision based on the law, not a case by case basis from landlords! Why he bought an apartment with sitting tenants when there are loads empty in my community is beyond me. He could have saved himself an awful lot of stress if he had either done his homework properly or bought an empty unit. Fortunately, our landlord thought he was doing the right thing by giving us plenty of notice to leave but this has given us sufficient time to lodge a dispute and make contingency plans. If your landlord insists on playing hardball with you, please take time to read stuff on the net (although some of the information is contradictory and confusing) but the minute you lodge a dispute, the clock effectively stops with your lease until a judgement is made. Your landlord cannot cut your DEWA off and if he does so, you should call the police. I know wasta counts for a lot here but apparent that doesn't cut it with the Rent Committee (but you never know who has who's ear). Lodging a dispute is a hassle but surely it is worth taking a day off work rather than than having to pay 30-50% more for an apartment or villa, agents fees (and dealing with unscrupulous agents in the first place), reconnecting Du, DEWA, etc and then actually having to move! There are some great landlords in Dubai who are glad to have their apartment rented and looked after and will play fair but there are increasing numbers who think they can treat tenants appallingly and demand ridiculous rental increases. I would far rather take a fight to the landlord and get at least one more year out of rent at the current level plus 10% or even 20% in accordance with the rent calculator. We are pretty sure the landlord will issue us with a 12 month eviction notice once our new lease is issued as he thinks he can get top dollar in rent for it. We also enlightened him that he couldn't rent the apartment to tenants for two years after an eviction notice has been issued on the grounds of his family moving in. If we are evicted, that will be our next fight and compensation is issued by the judge if he finds in the tenants' favour. A strong message needs to be sent to landlords that this behaviour and greed is unacceptable and I really hope that these landlords fail to find themselves tenants and end up seriously out of pocket. Expo fever has taken hold and sucked all morality out of some people. Expo is a long way off and there are plenty of apartments to be built before 2020. Move and get out of the situation? This will cost me around another 35,000AED! Not everyone has 6k kicking around I am staying put. I have to abide by the laws of the UAE so my LL also can I am a LL in the UK and I have to give my tenant notice. I wont be bullied or pushed around

Hi there ladies, I am trying to find out some information and have someone give me a bit of honest advice on my car's recent gearbox failure. I drive a 2007 Golf GTI, which has a DSG gearbox. Recently it started jerking in first gear and upon taking it to my regular service centre (not VW) they told me it was a mechatronic fault. They can order the parts for me, but to actually fix the thing, it has to be done by VW because of some special coding that needs to be put in. So, off I went to VW only to be told that yes, it is the mechatronic fault, and that it's going to cost me around AED20000 to fix!!!! I have trawled forums on VW faults and it does seem like an expensive thing to have gone wrong with the car, but before I go forking out almost half the value of my car, I would like to look at all my options, and not just take VW's word for it.... If anyone has a reputable mechanic that I can speak to then I would be supremely grateful for their details. Thanks :) I have an R32 and one of the major services was to change the transmission fluid on the DSG gearbox. Alot of places don't do it as it has to be drained in a certain way therefore only certain technicians are qualified to do this. I rang around all the garages and spoke to several guys who knew their stuff and in the end I had to go to VW as no-one else could help What is the mileage on your car? Did you have your last service at VW? I ask this because at the 70k service the fluid has to be changed and if it wasn't perhaps this is the problem Good Luck

And so it starts! They said they want to do things amicably and not go through RERA lol! These LLs are unbelievable! SL It's just started for us to too -we\re in the Greens and our LL is trying to put up our rent from 70,000 to 95,000!!! We're also expecting her to go the eviction route next…. I pay 75k and the rent calculator stipulates no increase so check yours too I am willing to come to a financial arrangement regarding renting a new apartment/moving costs. That will be the next email Yes they pay all your moving costs, make sure you get your full deposit back and anything else you can squeeze out of them ;) My friend negotiated the difference in rental costs to a new apartment as one beds in the Greens are now going for 100K! I don't want to get into a row with them but will go by the law if I have too Wow - 100K for a 1 bed!!? Who in there right mind would pay that? We're going to sit tight too - the rental calculator says she can put the rent up to 73,500 AED and we think that's fair ; ) One thing that worries me - If we fall out with the LL over this will she try and keep our deposit at the end when we vacate? I think most do that even if you have a good relationship with them lol Threaten them with the RC if they do.

I have kept all correspondence and before today I received an email in Oct 2013 from them asking me to provide them with a vacating letter to which I advised the 12 month notice period They did not respond to this and today is the first piece of communication I have received To be honest, I know it's a pain, but if I was you, I would try and sit tight and make them honour a new contract for another 12 months. OK so they may serve you notice, but at least you'll have a year to think about having to move. Our 90 days is coming round at the end of this month, so we're keeping a close check on dates :) edited by Geordie expat on 09/02/2014 It will cost me at least 30k to move as the rents in the area have gone through the roof Either stay for another 12 months or we come to an arrangement.
