Urgent advise please! Baby's UK passport refused

Does anyone have any experience or advise please. My 3month baby's UK passport application has been refused as she was born in Abu dhabi and they say as her parents got citizenship by descent that we can't pass this on to a 2nd generation of family also born abroad. Am shocked and worried as if I had known would have had the baby in the Uk instead then she would have got a passport automatically.
Have been told to now apply for British citizenship for baby, any idea how long this takes and procedure. I will speak to British embassy in UAE after weekend as can't get through to anyone in UK by phone but worried that will be fined if baby does not have residency visa after 4 months of birth in a passport. Can anyone recommend best way forward or who to contact to assist, many thanks. Both me and hubby have Brit passports and citizenship as do grandparents so can't understand how they expect baby born here to get UAE passport. I think it is called certificate of registration for child born abroad to UK citizen parents by descent.

I was in a similar situation but not so critical for me as my DH is American. I posted about it in more detail here: [url=http://www.expatwoman.com/abudhabi/forum/messages.aspx?TopicID=196646'>link[/url'> But in your case, I think that as BEDH says you may have grounds to appeal to the UK Home Office. You probably need to contact UKBA to start with. If you go down the other route as discussed in the old thread, I was told it would take around 6 months (!) but I haven't actually applied yet so don't have any more details on that. You can find all the info for applying on the UKBA website. Good luck. Shame that this is not more widely known, I wasn't even aware that I was 'by descent' either, all my family are English and the law was changed after I was born overseas.

unfortunately those are the rules, my youngest was born in auh and so i know that his kids must be born in the uk in order to get a passport automatically. we are british through and through, the first to live abroad so there is no problems in that we are british. the issue here is that you cannot get a uae passport so you must go back further down your original country. why has it taken you up to now 3 months down the line... you will have problems with immigration fines etc.

If neither you or your husband hold any other passport or are only British nationality you can appeal for you baby to be stateless and he/she can be granted a British Passport .

I am sorry to hear this. It is not uncommon. I have similar problem with Australian embassy - I am 7th generation Australian and my husband is on a Pakistani passport. Our daughter is now 8 years old and I am still struggling to get her a visa - even visit visa has rejected because of parentage. I think western countries are trying to "close ranks" as it were. Good luck.
