URGENT NEED ADVISE FROM MEMBERS- Srilankan maid wants to quit after 1 year with a 2 year signed contract !

Hi,

I needed response to a few questions linked to my maid's right to terminate the contract after only an year.

She is from SriLanka and has a 2 year contract with us. Her husband has suddenly arrived with a job in the UAE and he is pressurizing her to change her job.

Can she change to a new job and stay here?!! Is it as simple as that for a maid!!

This is so not fair and I felt really shocked and cheated as we have been rather nice with her. Apart from a very high salary (The Emirati lady at the Emirates id office was shocked when she heard the salary that we were paying her, as they normally pay 850 aed with NO day off!! and she even told my maid how lucky she was!!).

We live in a compound villa on the island and my maid has a separate room+kitchen+ bathroom and a separate entrance with WiFi installed and a day off. My kids are at school until 5 pm generally so she has complete independence.

She had come from SriLanka and we had sponsored her visa including flights and hotel (for a week!!) to a neighboring country to change her visa apart from all the usual expenses. Talk about being thankless!!

1) Is she eligible to terminate the contract? What is the procedure? Her new visa is up for renewal on the 1st of December and she has informed me today! Is this in line with the 1 month deadline?

2) As an employer, do I have the right to refuse to release her prior to the signed contract finish date specified as end of 2015?

3)Can we ensure that she leaves the country as she is currently on my husband's visa and apparently we will need a clearance form to hire another maid.

I really need to understand the legal angle which protects us, the employers as well!

Appreciate all your help and experience in this regard!!

We had decided to give her the option to leave as there's no point in forcing someone to stay with you if they are unhappy. Luckily good sense prevailed upon her and she has decided to stay and honor her contract. In fact, she's much more happier these days..!! :)

I suggest you get in touch with the relevant office at immigration for the particular questions.But generally, once a person has worked for a year, despite any stated length of contract, both employee or employer can give usually between 1-3 months notice to quit a job (including bankers and lawyers on contracts in the UAE whose employers have spent a ton of money to fly them over, pay their accommodation, children's schooling, health care, etc.). Even if not written into the contract, the same respect should be given to a domestic worker. Maids do not have the same labor contracts as we do I would speak with immigration
