Taking Legal Action Against a Company re A Bounced Cheque

Unfortunately we have found ourselves in a situation where we need to do this. This is from a "friend" of ours. He owns a small company with a partner and they have a local sponsor, of course. What do I need to do first in order to get things rolling?

I've already picked up the nsf cheque from my husband's bank branch - HSBC in Sharjah. I think I also need to go to this friend's bank and branch to get some kind of form or letter (?) Or do I go back to my hubby's bank branch in Sharjah to get something from them?

I did bring a letter from my hubby, since he's out of the country, copies of his ppt and visa and my ID. I'm just a bit lost on what to do next and I need to get this done in the next couple of days because I'm going to Thailand for 10 days this Friday.

I appreciate any help.

As far as I know, that last time it happened to us, we were required to bounce it thrice and then wait 10 days before the police would file a complaint. Maybe they have changed the rules since then.....ofcourse the guy is in Sau Paulo now....

the police will call him in and give him a few days to pay (usually). If the name on it is your DH's then I think he has to be the one to file the complaint.

Ok, here's a bit of an update. This morning I went to their bank branch at MOE and they said that I have all that I need to go to the police. I'm working night shifts this week, so everything is piecemeal. I'll go to the police station tomorrow morning. Hopefully it will be quick and painless. Will he have the opportun ity to pay or be jailed ??

The person who signs the check is the responsible party. Its a matter of record at the bank who has signatory power. Can you contact his other partner? Since you can't get him on the mobile is it possible he has already skipped town? You really need to get to the police and stop wasting time. They can answer any questions you have regarding responsibility: if the company can be held responsible for the check if he did a runner. <em>edited by Crystil on 12/03/2011</em>

No ulterior motive for this question but if someone gives u a cheque and it bounces how long is the process before you the person who should get the money finds out ???

I just checked the sig and it's one that you can't tell the name. But wouldn't the company have some responsibility?

My husband has already done that. We are sure he's going to skip. But what about the partner and sponsor? The onus would be on all of them, wouldn't it? Depends who signed the cheque.

Doesn't sound too good. Since he's now ignoring your calls, you have no choice but to go to the police and report it. Get yourself to the police as soon as possible and make a report. I'm sure he knows the penalty for bounced checks and maybe he's preparing to "take a holiday"??? Send him a text letting him know that you have been left with no choice but to go to the police.

It bounced once and our friend said he would deposit cash, transfer money a few times, never did, now he's not answering his phone. I got a phone call about it about a week ago and I picked it up on Thursday morning.
