LANDLORD AWOL....BANK REPOSSESSION

Hey Ladies,

Advice urgenly needed.

We moved into our villa in the Lakes in June 2010 and literally within days or as soon as our annual cheque for rent cleared the landlord went AWOL. Within 2 months we were made aware that the bank wanted to serve the landlord an eviction notice.

We have now been notified by the bank that when our rental lease comes to an end this June they would like us to vacate the property so that they can auction the property off.

The problem is that I have 2 children under the age of two and really don't want the hassle of moving again (this will be my third move in the 3 years I have been in Dubai.

Has anyone out there dealt with this type of situation - what did you do and what was the outcome?

p.s. we did register our rental contract with RERA.

There must be several houses in the lakes all identical that you could move into over a weekend! The kids would hardly know they have moved. Just dont get a villa thet is the opposite to the one you have or the poor things would be confused!! Trying to find a solution to stay in the house will take more time and energy than a weekends move. You might even get a lower rent. Our rent has halved since 2008.

I imagine it's more of a hassle to try to sort out an arrangement with the bank than moving.

You should go in and talk to the bank about your options. I'm pretty sure that when a person wants to sell their house, but currently have tenants, they can sell the house but the lease is honored. Which means the new owner of the house would be the new landlord. Technically this has happened to you and the bank is now your LL. If they push for the sale of the home fast enough, maybe the new owner would be interested in renting it out instead of living in it. Then you can start a new lease contract with the new owner. I know it's a stretch, but if you really don't want to move, then you gotta try to do anything even the far fetched ideas.

The same thing happened to us in a flat about a year and a half ago. We're in a condo in International City and we had rented a flat direct from the landlord. He had done some really nice renovations on the place and he told us that he was going back to his home country and he wanted to rent out the flat. We had given him a deposit, then quarterly cheques. Soon after he left, we got notice that he wasn't paying his maintenance fees. So guess what the management company did? they refused us any service when we needed it. We constantly had problems with the kitchen and they refused to do the repairs because our LL wasn't paying his maintenance fees. Thankfully we had registered with RERA so we found out what we needed to do. Unfortunately we didn't have any rights, as the management company and the mortgage company weren't getting their money. We move pretty quickly after we found out all of this, and, thankfully, we didn't lose any money. Shenkins, it's am major pain when something like this happens, and we've lived now in 4 different places in Dubai, but you have no choice. If you stay there, you will have absolutely no rights. good luck with everything and I'm sure you'll find a good place, there's quite a lot available now.

You will have to move and why on earth would you want to stay in a property with no LL and therefore no maintenance?

How awful for you although I don't think there is much you can do about it! If the mortgage hasn't been paid, the property belongs to the bank. I think they have been quite reasonable allowing you to stay in the house for the duration of your rental period. I say start looking for a new home and check that the new landlord is the outright owner next time.
