End of service bonus - housemaid
Our housemaid is leaving at the end of her contract in February, she is leaving by mutual agreement. She has been working for us for 5 years now as a live-in, has a salary of 3.500 per month plus extras for babysitting, visitors, annual bonus etc. Things have been strained with her this past year and her work and attitude have deteriorated.
She has already had her annual trip home and her 1 months holiday, plus an additional 1 months bonus. I was intending on giving her a leaving 'bonus' of 1 months salary and her one way flight home, however she has begun making overtures that she should be receiving 1 months salary per year of employment as an end of service gratuity i.e. 5 months salary at the end of her service, AED 17,500, and she will be using this to set up a business back in the Philippines.
We have been more than generous to her during her employment with us and overall she has been very fair to us, however that is a big sum of money to have to part with in a single lump sum and had I known that was the expectation, I would have kept her official salary to a minimum and 'topped' it up with extras and bonuses on a monthly basis. Her contract states her salary is AED3.500.
Any idea if we DO have to give 1 months gratuity at end of service, or would the one month 'bonus' we gave her every year off set that requirement.
