It depends on your company. You may check with your HR if he/she is nice or ask around about someone else that did this before. Not all companies follow the law. Anyway, it depends on your pregnancy, how you feel and all. I was super till 9 months, no sickness, no nothing, so I had no problem. Some have big problem, so… Hope you will be ok as me :)

Thanks Mpp but as far as i know i can take my maternity leave only from a month before the due date soo either i stick it out till then or else leave before Enigma, Below is extract from the UAE labour law qte Article 30 A female worker shall be entitled to maternity leave with full pay for a period of forty five days, including both pre and post natal periods, unqte so you can take it pre-delivery. What is unethincal about using your maternity leave and giving resignation after you use it?? When I was pregnant (high risk) I was advised to go on sick leave, but since I felt it would not be ok, I kept working and was given termination letter half way through my pregnancy, hence look after yourself and your bubba :)

Thanks Mpp but as far as i know i can take my maternity leave only from a month before the due date soo either i stick it out till then or else leave before

Hey all , i too am planning to quit after the baby but cant figure out whether i should: 1. Do the whole 8 /9 months and then take maternity leave so that i get paid for the 45 days (which i think i deserve after 3 years with them ) and then when maternity leave gets over then tell them i am not coming back at all or would that be unethical 2. Leave in my 5/6 month as anyhow once they find out i am not intending to come back they wont pay for the 45 days Please give ur valuable inputs You can take your maternity leave after 5/6 months, not necessary to wait till the end. If you resign they have to pay you also the end of service benefits too, so it is not so bad, but do that if you want to only after you get your maternity leave money. cheers

I resigned before my maternity leave ended. Gave the appropriate time in advance. Zeromaternity benefits. Didnt know those things exsisted here... Just got my regular end of service benefits.

I resigned before going on maternity leave - took maternity leave as part of my notice period. My notice period was 3 months and maternity benefit only the 45 days so I resigned a month before going on maternity leave, then took maternity leave PLUS 2 weeks remaining annual leave as part of the notice period. I had a confidential meeting with an HR representative before I resigned to clarify where I stood, handed my letter of resignation in only when I received confirmation that I could still take paid maternity leave etc. Is there someone you could talk to in your company? The maternity leave benefit here is so poor, I personally don't think it's worth it going back to work for a month after having your baby, just so you can get paid for taking a month and a half off. Unless you desperately need the medical insurance cover or something (it did came in handy for me).... My understanding (and the understanding of my former employer - which always did things by the book) is that according to labour law you still qualify for maternity leave even if you have resigned. But I can imagine that some employers ellect to interpret it differently.... good luck.

I haven't submitted my resignation but had let my intentions of not returning be known to management. Guess its a lesson learned to keep quiet when dealing with employers! Thanks JoannaS

If you handed the resignation letter already, then I do not think you can go on maternity. If you did not (and I understand that you have worked with the company for over a year), the best option is to deliver the baby, go on maternity leave, come back, give notice and go back to be a full time mum. I have definitely decided not to return to work and wanted to clarify the position on maternity benfits for non returners, do we have any benefits or is it purely company discretion? I am hearing conflicting advice, even the Ministry Of Labour is unclear in giving me advice. Have any of you returned in order to qualify for the 45 days benefit only to leave soon after? I definitely don't want to do that as I have made my intentions clear of not returning but feel I am missing out after giving a few years service to my company!
