Hi Shoyz, Actually, the 6 months ban still applies if the contract is ended before 2 years (no matter who ends it and even in the probation period). The problem is that the ban is put by the MOL and not by the companies themselves. Companies can only put ban if the employee breaks the law. I agree that you should check with the MOL, maybe there s a special case here.

As of 1st January this year the ban and NOC system no longer exists. But I just read it in Gulfnews today, that the ban still applies if you end the contract before 2 years Oh really? Ok, but during probation either side can terminate with immediate effect without any issues, that's what probation is there for. Okie! Thanks for the reassurance. I dont want him going back home, then again waiting for 6 months to start with the job hunt.

The best way to know is to call the Ministry of Labor , they have a toll free number you can call and they are very helpfull.

no - you can't be banned in probation period. But if you have concerns call the MoL and speak to a lawyer. They are really helpful.

I've not heard of anyone who was retrenched getting a ban. The ban is usually only enforced when people quit their jobs to move to a different company, not when the company has to let people go because they don't have work for them.

Hi Ladies, I just wanted to know if an employer is terminating you during the probation period due you entitled to get the 6 months ban or can you switch jobs? My fiance just got a job and now due to recession his company has issued notice that few of them will be sacked. He is into logistics as documentation controller & customer service executive but previously worked in retail sector. He is afraid that he might be in the list. With marriage round the corner out here in Dubai, I'm just hoping he doesnt get the ban. I dont know what to do. Can you please advice. I'm at my wits end with the marriage preparations and his work situation is not helping. :( Thanks in advance
