It's only going to get worse here! Owners don't want to pay service charges - they often don't want to! They want to pay the day to day charges ( sometimes) e.g. pool maintenance etc but no more. They don't want to pay into the contingency fund. They don't see the value of it. No common experience of the need for these things. Owners have been stung by developers who handed over all the utility bills for the construction period - I ask you! Not going to say the developer on here but big tower in the Marina.It's a downward spiral! Lack of trust issues all round. What's going to happen once the developers hand over to whoever will manage them - management company or tenant committe? Can you imagine?

It's now quite common - we were threatened with it (denial of use of pool, gym and parking space) and so leapt on our LL who paid up pronto. It's interesting to note though that non-payment of the service charge (resulting in denial of services for the tenant) constitutes a breach of the tenancy agreement on the LL's part. In exchange for taking your rent, they are duty bound to provide you with full enjoyment of the property (as well as it being in good order, etc...) so if they do not, then strictly speaking, you should not have to pay them. Of course, here contract law is often theoretical anyway, but it's a good argument to tell your agent or LL to get things going again!

Interesting...are we talking about a towere in JLT?? We had the notice in our tower and the letters was naming and shaming those who hasnt paid..thank god our LL name wasnt on that list..
