Out of jail, but not out of trouble. Stuck in Dubai over unpaid debts, German mother of three says she wants to be with her children who were deported while she was in prison

In June 2009, following the bounced-cheque complaint from her business partner, Konig was sentenced to nine months in prison after spending a month in detention.

As a result of her imprisonment, her rent cheque bounced too and four months were added to her jail term. She was further made to serve another four months for an "absconding" report lodged by the Free Zone authority.

"My children have gone through severe trauma. I just want to stand on my own feet again.

"I've been told that the Austrian government had arranged for their deportation. I want to tell my daughters that I am not a criminal and I love them. There's nothing else in life I want but to be with them, to see them grow up," she said. The last photograph that Konig has of her three daughters — who all hold Austrian passports — is two years old.

Caught in what she said was a "vicious cycle", Konig is appealing to "people of goodwill" and her compatriots to help her out of her legal limbo in Dubai. "Someone from the German consulate in Dubai visited me in jail with a list of lawyers, but I don't have the money to pay an acceptance fee," she said

It's a very sad case. I don't get one thing. As a businesswoman, she knew she had written a PDC to her investor/family friend for AED 480,000 so why didn't she ensure there was that sum balance at all times in the account? She knew at any time the investor could cash the cheque. I'm not picking up on her but just wondering why she left herself vulnerable... My husband had a bounced cheque because the bank claimed the date on the cheque (handwritten) was not altogether clear (a case of a "3" vs. a "5"). There was plenty of money in the account to cover the amount. The bank failed to notify my husband of the incident and Nakheel changed us a hefty 500 dhs on top of the amount of the check for the bounced cheque. Of course the bank also charged my husband for the cheque bouncing, etc. Since then friends have told us the banks bounce cheques using any excuse as this allows them to apply shrew bank charges.

Why didn't he just allow it to expire and be one less burden for this poor woman to worry about?! My understanding is that if you do not give notice to your LL that you are not renewing he is able to assume that you are. Given that rents reduced significantly during the period he would have carried the previously paid price across to the new tenancy contract. I also understand that a new lease cannot be established without the signature of the tenant however subsequent agreements are deemed valid without the tenant’s signature if occupancy can be shown and her furniture and personal items would be enough to do that. [i'>Please note that 'I understand' is just what I have been told and may or may not be 100% accurate as it was a LL not a lawyer that told me.[/i'>

Overall in this sad story my anger lies with the landlord. He obvioulsy found a loophole in their original agreement which he exploited for his own greedy purpose. How some people sleep at night is beyond me. Why didn't he just allow it to expire and be one less burden for this poor woman to worry about?!

I can not see anything this woman is actually responsible for, the cheque was noyt issued by her, the rent was renewed without her approval and the freezone thing is obscure. Terribly sad, why should she pay the rent?

That is so wrong! How can they expect her rent cheque to clear when they've had her in jail all that time?? Doesn't make sense. And how can she be declared as absconding - when they had her in prison??? I find this kind of thing so upsetting, and it is when I hear things like this that I question if this is really a place that I want to live in. I do like it here for the most part, but when I hear something like this, it just feels that we are never safe. I feel so sad for this poor woman.

terribly sad. hopefully they'll realise she can't stay in dxb jail forever! something's got to give surely..i feel for her children. wonder why the grandparents were unable to take all 3 girls. <em>edited by KrisVi on 06/01/2011</em>

And here jail sentences seem so arbitrary: for a bank fraud of 85 mil AED a guy got 3 yrs in jail, for a 200,000 aed a woman gor 4 months, for a rape a local got 6 months in jail, for a bounced cheque of 540,000 aed same sentence. And the guys that molested the couple in IKEA are still not behind bars....

It is stories like this that make me really question my decision to live in Dubai. In other countries, you have to work hard to get thrown in jail - at least do something seriously criminal. But here, it seems so easy.

Her story is sad but oh so true! A mishap in business, a bounced cheque and she ended up in prison. Then for not renewing the trade licence, JAFZA declared her absconding,although she WAS NOT, she was in prison!!! Kids now, although they have a home back in Austria, were taken by the child services there!! Is not the only story like this, that is why prominent lawyers here, like Habib Al Mulla are pleading for changing the law of bounced cheques. If you bounce a cheque with criminal intent is totally different thing, but here the practice of PDC has landed a lot of people in jail,especially in these times of economic crisis. And not all of them were living above their means, as some of people might think!!

I read the story on Gulf news this morning and I felt very sad for this lady. I can't imagine how hard I must be to try to sort out this situation here in Dubai when one is alone and penniless. Also I doesn't help when the landlord renewed the contract without her signature, is that possible? I hope she'll find someone to help her out this dreadful situation.

How are people expected to clear any debts if they are in jail, and to think her kids are without their mom, very sad.
