Anyone out there working on part-time contract?
How does your company calculate your gratuity?

I've been told that I won't get my gratuity because I am a part-timer and wanted to check if this is really is the case (according to the UAE Labour Law)

thanks in advance for any input you guys may have on this ....

You need to clarify if you mean part time (as in less hours worked) or temporary / casual. In this part of the world many people get the two mixed up and call "temp employement" part time. For part time employment gratuity is calculated in the same way as a full time employee for casual work their is no gratuity / paid holidays etc.

This is how I understand it. There is no labour law specifically covering part time work. Your labour contract, which you must have, whether you are sponsored by the company or by your husband, will state full time. So, by doing that, yes you will be paid gratuity. However, you will probably have a separate contract with your employer which details that you are not full time, but are part time. Your actual part time salary will be mentioned on your ministry of labour contract, so why would you not be paid gratuity? Your gratuity is calculated by your salary, which will already be pro-rata'd down to be part time. If they are being really sticky about it, they could also pro rata your entitlement of days as you are not working full days - but they could easily do this the same way that they may pro rata your holiday entitlement if they decide you shoudln't receive the full 30 days (or whatever) as a full time person. HTH FYI - laour contract takes precedent over any other contract - so unless on the labour contract it is unenforcebale...

I must be the lucky one ! Im starting tomorrow - part time and they are paying for my visa and 30 days holiday .. You are indeed a lucky one!! All the best for this! for OP - I was a full timer before becoming a part-timer, as far as I know, I get my gratuity calculated like before, but divided into two ... however, all could change with the change of management....

There are new labor laws that are 'supposed' to come into effect that will give part-time workers more rights (ie gratuity etc) but at present because working part time is still a grey area, it differs from employer to employer what they they so.

As far as I know you can find some jobs on part-time but they don't sponsor the visa and no gratuity I'm afraid.

I think that is true as they dont believe in a part time work here. It's full time or nothing
