Hi to all, need advice please? i got married when i'm 5 months pregnant. I gave birth here in Dubai last April,and when we applied for the birth cert.of our child, Al Baraha refused our application because of the date of our marriage. They told us to go to Dubai courts. We filed the case and we just attended the 1st hearing,the judge told us only the husband need to come back for the 2nd hearing. They told us also they will pass the case to the Public Prosecution to ask their opinion regarding for our case. Any idea guys what gonna happen to us and they baby? Will we go to the jail and be deported because of our late marriage ? Or we could find a solution for this big problem how to obtain birth cert.for our child ?

Hi sb85! Don't panic please, all will be fine i am sure. Copy DubaiCat on witnesses for the father of child. We are in similar situation and might go thru same, previously done research shows that this is normally settled after bringing witnesses to court. The difference with us is we entered the country already married, so the "crime" of getting pregnant while not married was committed while we were not residents yet. But since our marriage was in January and baby born just couple days ago ( married around 25 wks into pregnancy ) we expecting obtaining BC might not be easy. Anyway, stay positive and keep us posted! Stressing not good for neither you nor baby !! X Hi Alenka, big congratulations to your baby!!! my baby's almost 1 month old now. difficult to enjoy motherhood with this situation. Im very stress! just met a new lawyer today, he told me no need to attend the hearing because there is possibility the public prosecutor will pass our case to criminal court and if will happen we will go to jail and be deported for sure.. ! BTW we brought two witnesses during our 1st hearing in the court last week because that was the advised but when we're inside the chamber the judge asked them to leave the room,telling us only bring witnesses when the court said.so at the end its wasting of time for my friends. Please let me know when you apply for BC of your baby. Thanks!

Wow, what a mess. Funny how people are really cavalier about things when they move here and don't really think about the local laws or the consequences. Funny how people think comments like this are actually helpful or warranted. sb85, my friend had to go through this procedure recently because they got married when she was around 16 weeks pregnant. Baraha hospital initially refused to issue the birth certificate because they'd only been married 156 days when their baby was born, and apparently the legal minimum requirement is to be married for 180 days. Basically what they had to do was go to the court with two witnesses to confirm my friend's DH was the father of the baby. They were issued a certificate to prove this, which they had to take back to Baraha hospital. The birth certificate was then issued with no further problems, on the same day they got the certificate from the court. From memory (which is often unreliable these days!) the court section was Personal Status but I don't think they received any special help from anyone high up. I hope you get it sorted :). If you do a search on EW, there was a previous case like this and the Dad was just asked to confirm he is the Dad in court and I think sign papers to confirm this. We did asked also the help of the director but unfortunately he just advice us to follow the procedures in attending every court hearing. Which is we are scared about what will be the court decision at the end.. Wow, what a mess. If you were married before you arrived in Dubai and have since had your baby I don't think it's at all fair that they even think there is a case against you. You haven't done anything wrong since being here in Dubai so how an they prosecute!? Hello MrsRayner, We are living here in Dubai for 2 years and just got married december 2012 in my country, come back again to Dubai after the marriage and gave birth april 2013. We didnt know that when you apply for birth certificate they are really checking the date of marriage. If i just knew it i did not come back here to deliver the baby. Yes we did explained the situation to the embassy but they just gave us list of lawyers to inquire for legal assistance. We visited one lawyer that embassy told us, but the lawyer asking this and that documents that impossible for us to provide. So we attending the court hearing without lawyer. Just hoping that the court will approved to issue birth certificate to our child. But i heard it takes so long the procedures in the court.
