Employer Issues - Need Advice

Hi Ladies,

I'm sure this is a regular topic, and I've been around a while, but I've found myself in a weird situation with my employer, and could do with some advice. I work for a local distribution company, non-freezone, and have recently resigned. My resignation letter, mentioning a 30 day notice period, was accepted, and signed by the head of the company. The same has been communicated to all, and things were apparently going pretty smoothly. My line manager asked me to work an extended notice period, and I refused. My contract also specifies one month, and I believe the labour law does too.

This morning, I received a call from the HR Exec., telling me that it's apparently been agreed internally, that'll I'll work a 2 month notice period, and that this is a senior decision, since I am a manager, and should therefore be expected to give an extended handover. I swiftly responded that none of this has been discussed with me, that even if it had, I was not in a position to agree, and that I would not be doing so.

What I need to know now is, am I in a position in which the company can try to penalise or enforce this? I have:

1. A contract, requiring me to give a one month notice period
2. An accepted and signed resignation letter, specifying that I would be giving a one month notice period
3. BBM records of the same discussion with line manager

Any advice would be gratefully received. I am aware that while the law may be on my side, in actual practise, things could be made very unpleasant in the meantime. What are my options here?

Hello You need to check with whomever your labour contract is logged with. This is the one written in Arabic and is one page only ( we rarely see them) whatever it states on there is law.

If your contract states 1 months notice period, then the company has no right to enforce a longer notice period on you. All contracts are logged with the Ministry of Labour for these reasons so that if you have an issue, the version of the contract logged with them is the one which stands. Sometimes managers will have a longer notice period to work because of their designation but this must be states in their contract if the company wishes to enforce it. Your company is trying scare tactics so stand up to them! :) If you would like confirmation on this call 800 665 and they will confirm it for you. Good luck!

If you are worried - contact the MOL who will be abel to offer free legal advice and if your company is beign difficult can raise a case.
