Hello,

I bought an apartment a little while ago which was tenanted, I felt they were somewhat underpaying with rent, but since I've taken over, I decided to keep it the same, anyway its coming up to renewal, and the tenants want to re-negotiate the number of cheques...

I know tenants have certain rights, but they've got a really good deal which I was happy to renew under the same conditions, however now they're asking to change the conditions what are my rights? Do I have the right to say to the cheque increase? If they won't agree to continue paying as per the lease, does that mean they have broken the agreement and I have the right to look for other tenants or am I stuck with the same tenant for a lower rent and in more cheques? any help would be much appreciated, am trying to contact RERA too, but haven't had the time to go in yet.

Thank you for your responses, I managed to get through to someone at RERA who cOnfirmed i didn't have to accept increase in cheques and if tenants don't like it they have to leave....

You can easily say no to their request for more checks. If they don't like it they can leave.

Im not 100% sure but i think you can only raise the rent by about 5% - someone will correct me im sure but think its 5%. The number of cheques though is at your discretion. Also, check the contract, you may have to inform them of renewal or leaving by a certain date! Good Luck
