I dont think she will be able to do anything. They seem to be following the correct procedure for terminating her even though its after her maternity. The "Travel to KSA" reason can be a valid reason even though its quite possibly false but she hasn't got any solid proof of that. If an HR manager who knows all the labour laws etc. gets 'forced' to resign in that company then I think maybe its a blessing in disguise for your friend. Start somewhere new where you are wanted and appreciated. I hope I am wrong but I have heard this before and no one really gets anywhere with these type of things in this part of the world...
A friend of mine returned from maternity leave today and was terminated under redundancy reasons - she was told she was replaced by a male who can travel to KSA, however we know there are new HR people in KSA already having met up with some existing managers in the company in recent weeks). Also, her replacement remains employed in her role, so her role still exists and we believe she has been terminated as she was hired by the previous HR Manager, who was forced to reisgn over her being bullied, harrased and unable to work within unethical standards. They have agreed to pay her notice/dues accoridng to the UAE Labour Laws (maybe a little less, she is workign on this) however she is taking this further. Can anyone give advice on whether this regarded as arbitrary dismissal or not. This is a freezone. TIA
