Advice please....bit stressed - where do we stand at the end of the rental contract..?

Our contract says we have to give 2 months written notice to leave the property.
Our rental contract ends 31st August.

At the moment, we are in the process of looking for another place to live, but until we've signed on the other property, we cannot tell the LL that we are leaving at the end of August.

If we write to the LL, say end of July, that we want to move out when the contract ends - that's not 2 months notice. Where do we stand? Can he demand that we pay the rental to end of Sept (that's 2 months from giving notice)?

We have already written to the LL mid June that we would like to renew at XXXAED but he did not agree and it's been left at that.

Help - going round in circles here. If we don't move end of this month, we'll have to ask for an extension of a month - not sure if LL will say "yes" or where we stand if he decides to be difficult and so "no", and the contract finishes while we (and the maid) are still on holiday.

Hi, all the best in your move. Make sure you give notice 'in writing' of course...best to send a fax and keep the fax report or send by courier and ask for a copy of the delivery receipt (in case it is claimed later notice wasn't received) -email is best only if you receive a reply confirmation from the LL/LL representative. I'd also keep photos of the property on hand to prove it's been handed over in its 'original' state (only in case there should be any difficulty in getting your deposit back). <em>edited by glopora on 20/07/2011</em>

Thanks Ash. Yes, I fully expect and accept that there will be a transaction cost with the move...but we made the decision, move we will....

Breathe SB! :) You can defo get the contract in your name. No problem there at all. I would sign, give notice and put down the extra rent to Dubai expenses. Virtually everytime we've moved, we've had a rent overlap. :(

OK. Landlord will not consider extending for a month. DH is away on business, any reason why I cannot sign a rental agreement in my name? I have my own visa sponsored by the company I work for.

I'm not sure that the LL will regard your earlier contacts as *notice* - he may think that you are negotiating renewal but have just not agreed the price yet - did you actually say that you were moving out if he did not agree your price?? What are you planning to do with all of your furniture when you go on holiday if you are not planning to renew?

Yes mmp_jl, that helps. The contract is "renewable", it doesn't say that it is automatically renewed, no, not in those words in the way I understand it anyway. HAK - Thanks. Yes, I'm very aware that my holiday plans are not the LL's problem, I was just laying out the background....and crucially it was a last minute decision that we decided we need to move rather than stay put.....all the planning before had been based on us staying. Hi, First question is does your contract mention that if notice is not given the contract will be automatically renewed? If yes, than I am afraid you will have to pay penalty. If no, than you have no problem as long as you don't sing new contract - the contract is finished, no new agreement, no new contract.... you are free :) Second, if you are going on vacation during the time the contract is expiring, than if you don't have new contract how and where you will go, your things from your house will be where? If you find new place than you are ok, but if not? If your contract is expired and there is no new agreement on the rent with your LL by then, you can try and extend the contract with 2 -3 months for the same rent to give you time to find something as per your DH requirements :) after you come back from your leave. But this is only if your contract is not automatically renewed. I hope this helps :D

BUT the original plan was that we were going to stay where we are....so hadn't plan to having to move. The other added complication is that the DH is *&%#@&* fussy!! OMG, about location, noise, finish, state of the bathrooms, internet connection speeds!!:\: ^&%*&%&%&(^&^&690 Saltire - Do I know you? edited by Sugarbeach on 19/07/2011 Wellll... there's no nice way of putting this, but your holiday timing really isn't the LL's problem. I would imagine, since he does seem a bit intransigent, that you'll basically have to look to yourself, expect no favours and resign yourself to not being the most financially-efficient transition. I think that basically, you have to resign yourself to having a bit of cross-over, so you will find your new place, start up the rental on it (because they don't like to hang around), move house before your holiday and just finish paying the rent as per contract on your old place, even though you've vacated it. Alternatively, you vacate on the day, and move into a serviced apt until you find a new property.

SB, people generally just give the notice and hope to find somewhere, which they normally do. It is a chance you take that you might not get exactly what you are looking for. Or your LL may be happy for you to give the two months' notice then keep it rolling until you find somewhere, depends on the LL.

Have you got a phone no for him? If you speak to him directly he might be more approachable. My DH was in contact with our previous LL and we very unsure what we were doing. He gave us time to make our minds up and also time for searching a new property. Perhaps we were lucky but sometimes it's best to be in direct contact. He is most definitely entitled to his 2 months notice.

Yeah, but how can you give 2 months notice if when you are looking, people say they are only interested if you could move in in matter of days or weeks - not 2 months. 2 months in advance is deemed too early to look for a rental property.

Thanks P_I. Can you not argue that we've written to him already but we just couldn't agree on the terms (i.e. rent) under which we would renew our rent? If we move out anyway, what's the worst that could happen? LL keeps the 5% deposit instead of refunding? Also, how easy or normal is it in Dubai to extend a rental contract for one month, if we have difficulties with timings in finding the next property? <em>edited by Sugarbeach on 19/07/2011</em>

yes, it sucks. If you've got a nice LL or agent, you can say "ok, consider that I'm giving notice, but I will let you know 1 month before contract is up if I want to renew or move out". At the end of the day, they shouldn't get all ar$y about it, because it boils down to the same thing and everyone has enough time to look for a new place/ new tenants.

you need to give two months notice or you will be penalised - ie, have to pay him upto 2 months notice.
