Do nannies get days off on public holidays?

Hi moms,

Do you give your nannies / maids days off on public holidays? I am trying to search for the new regulations but couldn't find the most updated one. My nanny wants to have the New Years night off and 1st of January too saying that everyone is off that day :) I told her NO, but she can take another day off later in the month of Jan and she gave me "the look". If I say yes, that means we can say goodbye to our New Years plans to go out with friends that night. :( What does the law say? Thank you.

The law re public holidays only applies to employees not to domestic workers. Legally you dont have to give it to her. Until 2016, all domestic helpers didn't fall in same category. I hear its about to change in 2017.

Its too late now, however, in the future it is only considerate to set these schedules up in advance on large, especially Christian, holidays. It is really an investment to have someone in your employ who feels heard and considered. We have had no turnover since our marriage in large part before we always consider the personal and financial needs of staff when we make plans big or small around vacation, holidays and social engagements.

Giving a day off later because you've 'decided she has to work' NYE doesn't really make up for her missing out on spending the night with her friends and possibly family does it? Which is the point. If you've sprung it on her and only just made plans, it's unfair to expect her to work it. Besides, aren't these occasions meant to be spending time with YOUR family? Not ditching the kids to go out on social jollies.

I had a maid who was more concerned about her social life, than our plans, and would always ask for days off even though we had plans that day and get very upset if I said she couldnt because we already had plans. With my new maid maid I've told her she has every Thursday off and if she wants to change it she needs to ask me from before. For Christmas, I told her she can skip Thursday and take Christmas Sunday off which she was happy with. It's up to the maid to tell you in advance if she wants an odd day off thats not part of her usual schedule, you shouldn't have to check with her.

I do give her public holidays off most of the times. I also gave her two days off for Christmas (from the 24th Dec evening until the 26th of Dec evening) as we've been both on leave and we didn't really need her. We are pretty fair and treat her very nice, don't get me wrong. She is living a very good and easy life with us. However, I decided that in some particular cases like New Years Eve she has to work and she will get her day off later on in January :) Thank you for advising me! :) When did you ask her to work on New Year's Eve and did she agree?

I wouldn't have thought that there are regulations that say whether a nanny / maid is entitled to certain days off, it depends on the family and what they have discussed and sorted out. But I do have to ask, it is the 27th December. I am guessing that you made plans for New Year's Eve before today? It is not fair to spring it on your maid so late in the day. These kind of things should be sorted out months in advance, if not when you you were hiring your maid. I don't specifically mean New Year's Eve 2016, but generally about your expectations for holidays. Maids are people too, and if you haven't discussed it, maybe she thought you weren't going out and made some plans, shock horror... Some things shouldn't be about the law, some things should be about being a decent person and setting out expectations and talking to your help, not looking for laws to force her to do something. On the other hand, if you told her weeks ago that you were going out and she would have to babysit, and she agreed, then she will have to work.

Sadly maids do not fall under the same labor law that most other employees do. She is not entitled to the time off unless you agree to it Many families may compromise and give her a day off ( I have several friends that do this as they are usually off on the holiday so do not need her to be there)

As much as possible I do give public holidays days off..for times when I have social commitments I talk it out with her and give her another day off during the week . Thankfully this arrangement has worked over last 11 years ...she brought up my then toddler , she is a teen now and nanny is now incharge of my new toddler ...bless her!
