Filipino maid contract issue - re-entering Dubai this Friday...

So I am hoping someone knows more about this than I do..... please!! It may, or may not be an issue... but if it is, my guess is that it is quite complicated.

My friend is away at the moment, as is her maid (she is home on her year holiday to the Phillipines). Her maid is returning on Friday (my friend will still be away).

So my understanding is that maids need to visit the Polo office here prior to departing Dubai to get the certificate stamped in order to be able to leave the Phillipines, to return to Dubai at the end of their holiday. She did not do this, however, I believe it is also possible to do this in Manila providing they have a copy of the immigration contract with them, visa, passport etc. So, her maid went to do this - however does not have the immigration contract - they never signed one.

What I 'think' has happened, is that the company my friends husband works for, has processed the 'wrong' visa for her, and have made it like they employ her directly as a company, instead of my friend and her husband as the sponsor. I have recieved a copy of her visa page, and it has her occupation as General Cleaner on it, with the husband's company name on it, in contrast, our 'maids' visa has 'servant' as the occupation and my husbands name as the sponsor ... My friend's maid's visa is also valid for 3 years, our's is valid for 1 year...

I understand there has been a tightening of laws in the Phillipines lately around this. So my question is, do you think she is going to be able to leave the Phillipines without incident because she she is on a different visa that doesn't require the certificate, or is she going to get stopped because she is technically on the wrong visa in the first place? Is she going to have to lie to get back in the country?

Any thoughts?? Should we be trying to sort something else, or will it not be an issue...

Thanks LovingIt and Icedqueen, I really appreciate the responses. I have checked and she is not flying from Manila direct, so that is good news, and she is under strict instructions what to say, and what not to say. Good news is that she has an ID from the company - so that is going to help as well. Now, we just cross our fingers and wait, and change her visa when she gets here! If they question her at the airport, she has to be smart enough to say that she is working for xyz company and not an individual so that they would let her go freely. I don't think that they would bother as much with citizens that are on company visas. They know that the big money is with the domestic staff.

Also FYI - from my info if she has a visa ie not just a visa approval/pink slip than immigration cannot cause issues from her coming to Dubai - its only if the visa has not been granted and the stamp is not on her passport.

Hi - I have just gone through a similar experience and for what its worth here is what I know. The regulations have definitely tightened - our maid was from an agency (we rented her) but a few months ago we agreed to sponsor her ourselves directly (under a domestic/house visa). She was due to have her current visa cancelled and to return to the Phillipines for a 1 month break and then to return here. The problem we were told about was that due to new gov regulations there (and also because immigration officers in the Phillipines are on the take) that they would not easily allow her to leave the country with a "pink slip" which is an approval for a visa in Dubai. Please not that the pink slip is not a true visa and just an approval that visa will be granted by her future employer in Dubai. The immigration in Phillipines will hassle the maid and she will need to seek all sorts of approvals from POLO, get education certificates, etc, etc. The solution we found was quite simple - we flew her to Bankok from Manilla (Phillipine citizens need no visa for Thailand) and than to Dubai. In Bankok she doesn't get hassled coming to Dubai if she has a visa approval. We found this the best way to bypass the immigration in the Philippines and the overall cost of the flight with the transfer in Bankok was almost the same. Hope this helps. Good Luck.

Ok, so she has a company employee visa and not a domestic servant one sponsored by an individual. I don´t think there´s need for any procedures to be done in order to be able to depart from Manila in that case, BUT as you say laws have been tightened up recently so I'm not sure. If no one can give you any definite answer on this forum you could maybe ask any cleaning agency whether any paperwork needs to be done in Manila for people returning from holiday, as their employees are working on the same kind of visa.

Your post is highly confusing.....one minute the maid is away...the next she is here. POLO office interaction is only for her leaving the country in order to allow her re-enter DXB. Maids CANNOT get a 3 year visa.......so she SHOULD have problems coming back in...... Thanks Piggle - trust me, I know the situation is confusing, which is why I am asking advice from anyone that knows more contractually about this situation than I do. I have tried to make my post as clear as possible, but because of its complex nature, it is bound to be a little difficult to understand. Just to cover off your points: I have just re-read my post and I am sure I did not said she is here at all, she is away (and going to try and come back later this week). I do know how the POLO office works, and I also know, that she SHOULD NOT have a 3 year visa - but the fact is, she does (I have a scanned copy to prove it). Clearly it is the wrong visa type, but because of that, it carries different rules for her to re-enter the UAE (I am assuming) which is where my question comes from. She is under the wrong visa type, but, is she going to be stopped because of this, or will they take that visa at face value and wave her through. I am guessing it depends on who she gets on the day personally, but want to see if anyone does happen to know of any similar instances, although I am guessing these are rather unique circumstances given the gravity of the processing error in the first place... <em>edited by TanyaR on 08/02/2011</em>
