Having to get out of a rental agreement if leaving the country?

Hello,

Hoping someone can help with a rental query. If we wish to terminate our rental agreement early because we are leaving the country, are we still subject to the 2 month penalty which it currently states in our contract for early termination? If we do leave, we would be needing to leave Dubai at the end of Feb 2013 and our rental agreement is until the end of July 2013. We have just paid our 2nd cheque of 3 so technically paid until the end of March already. Thanks a lot.

Will see what the LL says - to be honest, not holding out much hope of being allowed out of lease without any penalty as the LL is a large company and hasn't been easy to deal with thus far!

Slightly OT but I don't suppose you live in Springs? We are looking for a villa there for mid-end of Feb 2013, preferably a 3E or 3M No sorry :( Good luck and hope you find the one you're after!

as long as you give LL 90 days notice you will not have to pay the penalty. There is usually a clause in the contract asking for 2 months rent as penalty even with the notice.

as long as you give LL 90 days notice you will not have to pay the penalty. SalsB is that the law? We have the same predicament - gave 90 days notice in writing (contract asks for 60 days notice). Contract ends in April but we need to leave in December. We have prepaid up until January. Landlord is insisting we pay 2 mths penalty.

if you are breaking your tenancy contract early, you have to pay the penalty of 2 months as it's stated in your contract. This is the law here. You could speak to your LL and ask him if he is kind enough to forgo the 2 months but in most cases they do not but you never know :).

LL can cash your rent cheque then refund you one month or give you back the cheque and you pay him a month.... Some LL will not charge you the penalty if you find a new tenant - talk to LL.
