I have/had a tenant. His last check, went to the bank and he had closed his bank account. He was approached several times but did not pay. This was last year. I am going thru the rental dispute system and waiting for the eviction department to set a date to open the apartment. But in the mean time I got a message from the building maintenance team that water was leaking from the apartment and they had to turn the water off. Now I am concerned in case he left the water running and turned on all the electricity before he left.

Meantime I wait, the proceedure was started in late April. I went to the first court case on May 18th. The tenant did not turn up. Then there was two more court dates, also the tenant did not turn up.

I have registered the check with the police.

Is there anything I can do????

You can get sued if you open the property without a court order. OP did you check with immigration if the tenant is still in the country with valid visa or not? It might accelerate the process but I don't know how easy it is to get info from them. Maybe the guy is dead?

So there was water leaking and the water has been turned off and yet no one has accessed the apartment? As an owner I certainly would have done. Given that the rent has not been paid, the tenant is in breach of contract and it was an emergency, I'd have gone there and gained access to see what was going on. I ALWAYS keep a spare set of keys in case of an emergency situation. If the apartment has been left empty all that time, I dread to think of the state of it inside. Don't most people change the locks? I have done as I have no clue if any previous tenants have old keys. I do inform the LL of this but they have never asked for a spare key No, as changing the locks without permission can put you in breach of your tenancy contract. I got several sets of keys when my apartment was handed over and the management company who deals with everything, advised me to keep one set - for emergency cases only. Luckily my tenant is awesome.

I am confused, is this bad tenant still living there? You mentioned he bounced a cheque last year, and since then ......what has happened? I thought the rent committee were now hearing cases within 6 weeks.

It seems like you have done all you can for the moment. It doesn't seem like anyone is living there without water anymore, I hope you don't get a hefty dewa bill. Such a bad tenant.
