Doctor requires an extra day off for pregnant working mom!

Hi Ladies,

Can someone tell me if my company has the right to decrease my salary if my OB requires me to take an extra day off? She advised me to work 4 days a week only since I am having a delicate pregnancy and practically speaking I cannot quit working.

I cannot find anything in Labour Law.

Ask you doctor to write a letter stating this. Or if she can give you like sick leave form saying you need rest. If you don't take rest properly then you will only be signed off work for even longer, meaning they will have to pay even more sick leave.

If your doctor requires you to take an extra day off, I would classify that as sick leave. How your company deals with sick leave should be in your contract.

If the doctor signed you off for sickness then you would have to take sick leave or unpaid leave until you returned to work, why should it be any different because you are pregnant? I agree with the others, less hours = less pay or use the maternity leave entitlement.

Well if you work less hours of course you get paid less. In any company regardless if you are a man or woman you will get paid less if you work less. You cant expect to be paid for hours you are not putting in.

It will be interesting to hear how this one turns out. I don't agree that this would be considered maternity leave, it is not. It is more like how a company would deal with an employee on doctors orders for any other ailment, should it be considered differently because it is pregnancy related? Please update us op on what MOL advise!

I think you best contact the Ministry of Labour for this, and have a good look at your contract. Your salary logically speaking is for an X amount of hours. If you were to work less hours, it would not make sense for an employer (from their perspective) to continue to pay you the same salary. Your contract might have a clause that covers this, and maybe you can speak to your HR department, if your company has one. Pushing for same pay while working reduced hours might not sit well with your employer though, but I would really check your contract and contact Ministry of Labour.
