Getting deposit back

I know this has been asked numerous times, but any current advice would be helpful.

We vacated our villa at the beginning of June. It took us a number of weeks to even get someone from the LLs agency to come and view it and we are now being told that we can't have our deposit back as the LL is out of the country and unavailable to sign a cheque. Any offers on where we can go next for this. Thanks ladies.

When they tell you there is nobody in the country to sign a cheque you can remind them that we live in an advanced technological world and that you will happily accept a bank transfer from wherever the LL is instead :) Oh have no fear we had tried all that :) They then said they couldn't contact him!!! I am now assuming that they have a wonderful bank account that pays them loads of interest, so it is in their interest to keep peoples money as long as is possible. ;) I'm just pleased the cheque has gone through

Well we got our deposit cheque back - minus 1k - which I thought was quite reasonable as the villa hadn't been repainted in three years. It would have cost us more than that to have it done ourselves. After taking some advice we threatened to take the agency to the Rent Committee, not the LL and bingo we had the cheque within 24 hours :) Fantastic news!!! :cool: When our LLady refuses us ours, maybe I will threaten the terrible agency with RERA too, as the problem is they do not communicate our issues/threats back to her. I think that was our problem too. They kept saying the LL was out of the country or unavailable to sign the cheque. After we had spoken to a friend, who's a lawyer, we went straight back to them and just said we were going to the Rent Committee the following day, as if by magic, one cheque :) They even banked it for us and it has now just cleared :biggrin: Blimey! That was fast! ;) Well, you now know that they had your cheque all along and were just trying to pocket it, terrible! You know to steer clear of this agency in future! On another note, I might need a good lawyer for this hassle I am having with the moving company!! Terrible what they are putting us through!!

Very much sounds like a smoke screen. It wouldn't even surprise me if the LL is in Dubai and it is what they are just telling the agent! I think its time they met your husband!!! :lol: I really don't want it to come to that as I quite like living here now ;) Hahahahaha weeelll needs must GE!! My husband is quite a placid Geordie, it takes alot to get him going! But landlords, rent issues, and the terrible system for tenants revolving around leasing is one of the things that gets his goat! :biggrin: Mine's normally ok apart from when he's driving and I need to remind him to keep his hands on the wheel, or get deported :) This is different ball game dealing with LLs

We have "stayed on the case" the agent is getting an email one day and a text the next. He says that he doesn't know when the LL is returning, but we suspect that is just a smoke screen to try and make us give up. They haven't met my DH yet!!!! We've informed them today that we are going to RERA and taking legal advice unless we received the cheque (or cash) within 24 hours. Let's see what happens now, although I am not holding my breath.

I imagine it's a landlord who thinks that by making it difficult, you'll eventually give up and let the matter go. You really need to be proactive and stay on his case the whole time till you get the cheque back. From my experience of going to RERA about our landlady, they wont ring them and for most, it certainly wont scare them if they do. They know how to play the game. Its like a game of bluffing, until the tenant officially files a case and the LL receives notification of it, they will play the game and keep the money. In the case of my LL, she would not give two hoots if she received a call or notice to attend court for the case we filed... its a disgrace the way they behave!

Any offers on where we can go next for this. Thanks ladies. When you say you have been told you cant have your deposit back, do you mean permanently or just until the LL is back in the Country? If the latter, when are they back? It really is so unacceptable! It annoys me. We are moving this Friday, and we wont see a penny of our deposit we gave, she tried to increase our rent by 14,000 AED so do we think we are getting 5,000 AED back? No chance! If you are being told that you will not be getting the deposit back ever, you need to file a case with the Rent Committee!

Some LLs seem to be really horrible about returning deposits back! In the 'old days' you used to give the LL an undated cheque for the deposit and it wasn't cashed in unless there were repairs needed to the property upon vacating. Most of the time you would just get your original cheque back. Nowadays, they take the cash and when it comes time to return it, they stall and stall and stall until you give up. And you have hardly any options apart from keep trying and perhaps threaten with police/court if all else fails. I think LLs should be asked to place the deposit cheques in an escrow account (just like payments for off-plan properties) and the tenant can then collect them upon vacating unless the LL can show that there was damage to the property beyond normal wear and tear.

Have you given the keys back yet? No deposit, no keys! Yes they know that, but the property is so easy to get into even without the keys, that that won't be a problem for them. All they need to do is change the locks. Also we know that it hasn't been re rented yet.
