After having enough of our landlord, we are moving out of our villa. He tried to raise the rent by 15 k then threaten us that he would not renew if we would not pay. He insisted he put a clause in the addendum which made the contract not renewable. After months of emails and phone calls he finally understood the law was on our side and he decided to give us notice that he will move in himself next year. We instead decided to move out now and forget about him. We have done landscaping works worth of 30 000 k last year , and I am moving it all to my new house. BUT , I just came to know he is now advertising the house for rent with beautifully landscaped and mature garden- MY GARDEN!!!!! He is also saying the pool is leak free which is not true! I also had agents lurking around my villa yesterday with prospective tenants and I have never been informed or asked permissions for viewings. This morning he just sent me an sms at 12 telling me someone will call and see the villa at 3:30!!
He is a very dishonest man and makes my blood boil!! I am also sure we are going to have trouble getting our deposit back.. Does anyone have experience with that? How is RERA dealing with deposit issues and can I deposit the keys there (RERA) if he refuses to give us back the deposit?

Eli, You have RERA on your side, if he has made you move out on the pretences that he is moving in himself, yet is advertising the property for rent, he must pay you compensation, if I remember correctly, he may have to pay you up to a years rent for messing you around and making you move out by deceit. RERA is actually really good with these situations, I would at least get the compensation for your agency fees you're going have to pay to move, your moving costs etc... Either which way don't let him take you for a ride, grrrr hate these LLs

I hear you!! I'm going through the same, wont bore you with the details as it's the same as everyone else, LL not providing adequate notice in order not to renew as he wants more cash. Anyway, my question is. If I don't take him to RERA and I just sit tight, does he have to take me to RERA. You see I don't see whty I should go to RERA spend more money and time. If i have sent him the RERA regulations and reminded him what we signed in the contract with regard to notice then if I refuse to move out, does he then have to take me to RERA? You see if he takes me to RERA I'll win anyway. Yes - sit tight - he will have to take you to RERA to get you out and he will lose - you have every right with a renewable contract to stay. Please keep all e mails/texts etc and do not enter into conversations put evertything in writing. he is wrong and Rera will let him know that....

And now they are late also! :\: so maybe he thinks that it's my duty to sit around at home and wait for people . That's if they even decide to show up at all... At least you can warn them of the leaking pool. You do not have to show people around. Make sure they know that you are not intending on moving out......I did that and we didn't have any more viewings!!!!! the agent was very surprised when I said I was surprised that he was showing people around when we had no intention of moving out - didn't see him again!

jaddey- No I did not make an appointment. Just took my contract with me and told them that I need advice. The RERA office is inside the Land Department in Deira. How I got there like this: Took al Garhoud bridge. After crossing the bridge I followed the signs to Deira City Center and Al Banyas street. After the underpass you will see the City Center on your right. Stay on that street. This is the Al banyas street. Continue on that street until you see the SHERATON Deira on your right. Excactly opposite the Sheraton hotel is the land department. Go the main reception and they will guide you. If you can speak to a man called Mr. Hamdan. He seems to be the manager and is very helpful. The other local man is good too. Avoid the local ladies. They are too busy texting on their blackberry and they are not that knowledgable. :&gt;)

Akia, did you have to make an appointment to speak to RERA or just go in? where is the office? I don't even know where their office is and can get through to RERA but not the rent committe people on the phone. I really need to talk to somebody face to face as I'm another one having LL nightmares at the moment.

JC11- you make a good point. When I went to RERA the local man told me that I only need to remind him via email. If he wishes to kick me out, he has to sent the notice. But yes, I don't think you have to go to RERA. You can easily sit and let him do the work. He must be stupid if he takes you to RERA after knowing he is doing something illegal. He will loose and get a tongue lashing. I will not take my LL to RERA either. I will have a newborn soon. I have more important things to do than trying to explain to those people the obvious. Let him bring it on if he thinks he can win! But obviously some of those LL can get nasty. Phone calls, visits at your door steps and making demands and harass and even threaten you. The local man at the RERA simply said to me: "If he has a problem understanding the law, tell him to come and see me."!!!

You see if he takes me to RERA I'll win anyway. He has to give you a proper notice if he wants to increease ( Increase is allowed only according to rera) as per the contract. If there is nothing mentioned on the contract then the 90 Days RERA notice will apply. Failing to do so he can't even get the legal increase if he's entitled to any. If he has proper reasons for not renewing - wanting to sell or moving in himself - he has to give a 12 months notice. Failing to do so, he cannot kick you out. If he takes you to RERA , he has to pay the fees ( 3 %?) and he will lose. Don't worry !

I even had one friend whose contract said something like, 'Any improvements to the garden become property of the owner". Read your contract carefully...if it's not in there, take the lot and you don't have to tell him you plan to do it. Your landscaping company may even be happy to uplift, move and re-install it all for you (for a fairly hefty fee!). He sounds like a nightmare. Document everything, stay in touch with the rental committee and get out of there. hi greenish...My contract ironically says that I have to remove all the fixtures and leave the place in the exact same condition! He is on the moon as he did not even read his own contract! I would have never signed a contract that was not allowing me to remove the garden if I wanted to ! I have already sold all my sandstone tiles and removed half of my plants which they are sitting nicely in pots, doing perfectly fine. My only worries now are with the fruit trees and bamboo trees...not sure if they will survive but willing to take the risk. I am not saying anything to him but I did say it to agents and prospective tenants viewing the house, as half of the garden is gone anyway. So I guess it’s a matter of time until the agent will let him know.

When I hear the word "landlord" it makes my blood boil! I know where you coming from. I am currently facing issues with mine. After we moved into his apartment, he calls us back after five months and says he needs to move back by the end of the contract. Did the painting, custom made blinds etc. But I found good advice here and I am not moving!!!! Rera told me that I can renew for a year, and I will! I am sick and tired of those greedy ******** trying to suck out every penny of honest and decent tenants! I am sure they are so desperate for money that they watch doggy dubizzle adds every day and jump at every add that would promise them at least 5 K more rent than you. So than they go and harass you to move out if you don't want to pay! The property market is a joke here! Anyways! My advise I can give you: 1) NEVER RETURN THE KEYS UNLESS YOU GET YOUR DEPOSIT! 2) TAKE A COPY OF THE ADD OR THE SMS HE WROTE YOU REGARDS THE VIEWING AND GO TO RERA! YOU CAN CLAIM COMPENSATION! If you paid money for it, don't let him bully you out. He will loose his case at the RERA if you go there. And he will have to pay! Sorry you are going through this. Apparently this happens a lot these days. I think those stupid landlords think that the market is going up. Rera will put them back into their place as they are trying to inflate market prices again based on speculations!
