Quick Visa Question

My son's current visa will be expiring while he is away on vacation. He will be changing his residence visa when he gets back, and he does possess a passport which entitles him to a tourist visa when he comes in. Question: Do you think there will be any issues for him to return with the expired visa -- and enter with the same passport? FYI, he just found out that he will not be able to cancel before he leaves as signatory company sponsor is away on medical issues and is already gone. What do you think ladies?

Sorry Couch Potato, didn't intend to take a nap but this heat today zapped my energy. Why is it so hot for early June? Anyway, yes, his visa will only have been expired less than a month by the time he is scheduled to return. Have advised him there may be that chance he will be pulled aside and to be prepared for it -- but he has now booked his ticket today and going. As a side note, I have not been to the Immigration Dept for a number of years, and I can report that today's visit was pretty smooth in that they have now created a ladies section for each department and was able to get in and out very quickly. Big progress as I used to spend a great deal of time there processing paperwork when I had my businesses. Thanks everyone for the input.

For those ladies who might be interested, I went down to the Immigration Dept this am and spoke with two different people. Each told me the same thing. (thankfully). Both said it was best to cancel before he leaves. However, if his visa expires while he is out, he will be able to come in through his passport on a visit visa. Son is so relieved and looking forward to joining his school friends for a tour around Europe no matter what happens. . Norak I think in your case this is because he will be entering within a very short period of the expiry, and you would not have received the same answer if it had expired 4 months ago or 6 months ago, please confirm

His sponsor needs to cancel it, if it is not concelled he can't enter the country. Why doesn't he cancel it before leaving? OP said in her first post that the sponsor signatory is not available to do it.

I suppose it depends who is on the desk at the time

Norak - just make him aware that when he does come back in he will still be stopped at immigration. They cant stamp any new visa in before his old one is cancelled. When my daughter tried to enter on her UK passport with a visa that had expired by one day, she was taken to a small office and told to wait while immigration contacted her old sponsor (Dad!). DH had to confirm that he had no objection to them immediately cancelling her old visa, and allowing her in on a visit visa.

I'd phone Immigration on that one Norak. If it's within the 30 days of expiring he might be ok. Though exiting and expiring and entering within that 30 days, or just after the 30 days, complicates it. Please let us know!

Thanks for the additional posts. His visa will still be valid for at least three weeks at the time he leaves. It is when he returns that it will have been expired.

Wasn't there a thread about this recently where someone said it could be a problem to enter after a visa is expired, not cancelled?
