HELP PLEASE: how to help Filippino worker with deportation ordeal.

While I was away over the summer the husband of our housemaid was deported. As you can imagine this has been a very traumatic experience and I am trying to help.

Basically he was put in prison for over staying in 2003, even though he was cleared of overstaying back in 2003 through an amnesty. He had been to and from the Dubai to the Philippines in 2005, 2007 & 2008 without any problems, so they have no idea why this is happening. He had a valid visa and passport.

He was thrown into prison and then deported without any consular help and his wife has been told a different story every time she goes to immigration in terms of what she can do and how this can be fixed.

We dont know if it can be fixed as she was told she needs to pay a fine and come back in two days to pay, and then when she got back there she was told, no he has a ban that can not be erased and that he can not come back to the UAE.

I have called the Filippino embassy on 042207100 and can never get through to anyone.
I am not sure if there is another number I can call or if there is a local organisation to help Filippino workers in this situation, or perhaps an immigration lawyer who takes on these cases probono ?

Go to the POLO offices. They never answer their phones or reply to email.

Sealove thank you very much for your suggestion - very helpful. I didnt know that this organisation existed. We have been in contact with this organisation and at least they have offered to at least review the papers and try to help us understand what is going on.

It could even be that the passport/s he used after the ban were found to be suspect. it happens all the time. I once had a maid who was here on her sisters passport. I only found it out when she'd worked for me for years told one of the kids that she wasnt really a certain age. Her husband hadnt wanted her to travel so she just got herself another passport in her sisters name. All kinds of jiggery pokery can be got up to with passports in that part of the world.

It sounds to me as if someone has placed a ban on him and wants it enforced. Could be a previous employer, maybe a local. I think you need to look into the past to understand this one!

Any suggestions where to go for help? It seems like all she can do is to appeal which is probably not an option due to cost of legal fees. Is there any organization that provides pro-bono or reduced legal fees to workers here?

Actually it is nothing to do with the current employer who had just sent him on a training course and given him a promotion. Immigration has consistently said it is something to do with the 2003 overstay, but havent been consistent as to why it is a problem now given that this was supposed to be all sorted in 2003-2004. Nor have we had a consistent explanation as to how to fix or if it can be fixed.

Immigration often find things much later. A friend of mine had her/her kids UAQ visas renewed, but a year later when flying out of Dubai airport one of her dd's passport was showing up on the system as not renewed. The visa had been placed in the pp but not on the system. All kinds of things go on....

are you SURE that this was the reason he was being deported? Have you contacting his employer and their PRO? Have to say I agree. It seems highly unlikely that if he got back in '05,'07 and '08 without a problem they would be catching him for an amnesty breach in '03. esp if he had work visas inbetween..... and how long to Filipino passports last? wouldn't it be unlikely he was using the same passport bearining in mind that 2003 was for an overstay so must hve been here at least a year..... if not 2+..... doing the maths :)

I finally got through to the consulate only to be put on hold for 30 minutes before the line dropped out. Have also called the number 0506544047 too many times to count and no one every answers. Not much point having an office of overseas assistance if no one ever answers the phone!

Try calling the POLO office and see what they say. I [i'>thought[/i'> that those who took the amnesty could not return, but I may be wrong. Rules change all the time.
