We have been given 12 month notice to vacate our apt last May..since then our apt has been sold, does the new owner have to give us 12 month notice as well? Has anybody gone through something similar? TIA you have been given the correct notice of 12 months, the new owner doesnt need to give you another 12 months, he has to honour that contract, so the notice period that has been given, also couldnt put up the rent by a stupid amount just because its new. it works both ways!

I would like to renew my Tenancy Contract for another year and our present contract expires on Nov 4, 2013. Going through the contents of our contract which was prepared by a real estate agency, I read: 1. Renewal of the Tenancy is at the discretion of the Landlord. 2. The Tenant has to submit 90 days written notice prior to the end of the Tenancy Contract to the Landlord before vacating the unit or renewing the tenancy contract. I failed to do this. Will the Landlord have the right to eject me immediately on Nov 4, 2013? No, if he wants to suggest any changes he also needs to contact you within those 3 months. Failing that the contract roles over again for 12 months ( providing you aren't on a non renewable, which you will see written on the contract)

If the OP was given 12 months' notice back in May this year, and it was communicated in writing in the appropriate manner, then she has to leave in May 2014. The fact that the property has been sold in the interim makes no difference. The new owner certainly doesn't have to give any additional notice over and above the 12 months that has already been served, and presumably they bought it on the understanding that the tenant had already been served with notice to leave. The only possibility of wiggle room would be if the notice to quit wasn't given in writing, in which situation the OP could take a case to the Rent Committee. If the new owner plans to continue renting the property out, and they don't have anything in writing to confirm that the OP was served 12 months' notice in May, then there's a good chance the RC would force them to re-rent to the OP. <em>edited by Madge_Gustard on 29/09/2013</em>

I was told that the new LL has to buy with tenants residing,and lease accordingly, but I really havent got a clue who is telling the truth.
