DH works in construction, project he was working on is finished, most staff have left or being placed in Saudi on new projects. DH's boss keeps telling him to look around for other work, and that his redundancy letter will be issued soon. DH got a letter today saying that his services are being terminated due to technical reasons, according to the UAE Labour Laws 117. This law states either party can give one month's notice. They are using the term 'technical reasons' as they are trying not to pay out redundancy money. He has been with the company since 19 months. Does anyone know what he should do?

Birchy: The letter says they are terminating his employment for technical reasons - I spoke with the MOL today and they told me an employer can write what they like when terminating employment (hos bizarre). They told me that he is entitled to cost of air ticket, pending salary, pending annual leave payment, 30 days notice (gross salary) and 7 days per year gratuity. Does this sound right?

Ginne don't be so naive, simply change your Facebook passwords. well I dont think it has anything to do with passwords as when you type in facebook onthe bb, it automatically comes up opened. but I do log out now after each session. do you think i need to change the password? change the password - but why are you logging into your facebook on your husband's company phone ?? have i missed something ? lol Well he used it at home, on weekends, holidays, and I dont have one, [b'>so while we were out and he was blabbing away to his friends in Arabic, I was able to browse facebook etc and not feel so bored!![/b'> ;) Seriously? :( I dont really see the harm in it, it's not like it was being done in work hours while he's supposed to be doing 'business'. I know lots of people who have company phones who also use them for personal things. Its not like it was costing them more or anything. after the way they've treated him after this redundancy I really have no regrets!!! I wasn't referring to using the company phone - most people do that - its the fact that you 'went out' together and he just seemed to ignore you and not join you in the conversation, to the point that you need to use the phone to keep entertained......that's sad! edited by Pomegranate on 26/01/2012 noooooooooooo!! ;) it doesnt happen all that often, dont worry!! if we are with arab speaking friends, they all make the effort to converse in English but sometimes they go into arabic. I get bored easily and am not that talkative myself to make myself start conversations in english (i try to an extent, but im not a big talker and run out of words easily. I'm more a listener) dont worry, we do have nice outings and times together and mostly it's enjoyable for me, but also i cant blame him for wanting to converse in his mother tongue from time to time.;)

There is a clause for redundancy under the UAE Labour Law however it is called Arbitary dismisall, having made numerous people redundant and given the time that he has served with the present company, he may be entitle to one months notice and one months compensation as classed as arbitary dismissal, under no circumstances would i sign a termination letter. Article 117 is not as clear cut as it may seem so my advice in general would be to approach the MOL in Al Ghusais. On another note I know that a company in MEP and Construction are hiring at the moment he can send his CV to [email protected]

In any case, the company would have done a complete wipe of the Blackberry anyway. when you initially set up facebook on BB it asks you for the username and password, which it saves and automatically logs you into when its on. yes!! so does that mean it will still log in automatically? I've changed the password now, but i dont have the blackberry anymore, so will they still be able to access it? I managed to wipe the history log on the bb, so hoping that will have helped Oh my goodness ladies - Yes, the BB saves your password so you automatically login on your BB, but if you change your password, then it will detect an incorrect password and not log in!!!

Sorry to hear this bad news. I'm no expert in what to do, but I do know what you're going through as my husband was also made redundant. 1 months notice. they cut off his blackberry the following day (didn't even have a change to sign out of facebook, so now anyone can go on there i guess and if so inclined they can go through my facebook!) and cancelled his insurance (well, it's now emergency only - so unless we're dying of a heart attack or had a car accident we're not covered for anything - too bad, as the girls and I are all sick with bad colds and i have a broken toe which needs surgery) They were very underhanded and cruel. he suggested they let him resign instead (better on the cv) but they were having none of that - all about the ego I think. I hope your hubby gets more work soon. I know my hubby was due 1 month of gratuity, but they'll be taking in all as they had paid one semester of the girl's kindy, so will be taking out of that (most of it) to pay that back. Good luck with your future here, are you working? I'm not, so we're hoping hubby gets work soon :(

If you will be considering a legal battle (hopefully it will not come to this) - this is very time consuming process Not worth it financially either. It will cost far more in legal fees than he could hope to win in compensation.

Some employees have left or issued with redundancy letters (or do they call it termination of employment) and some have been posted overseas. LMAO-DXB - thank you will get back to you shortly. Think the letter said he can leave on the 23rd Feb but nothing about 'dues' mentioned. They are clearly making him redundant so should he not be entitled to the severance pay? As angelinaballerina said there is no such thing like redundancy in UAE Labour Law. Speak to the legal advisor in Ministry of Labour - they are very helpful. Hope your DH will rcv his dues. If you will be considering a legal battle (hopefully it will not come to this) - this is very time consuming process. In the meantime I would advise your DH not to sign anything (he can always ask for some time to understand the document/process) and seek legal help. Good luck!!

Unfortunately there is no such thing as redundancy here - basically you can be sacked on one months notice (or 3 depending on your contract). Sorry for your situation.

Hi Mrs Orchid Sorry to hear about your husband's situation. Unfortunately I cant advise about the issue he's having with the company being sneaky! Hopefully one of the other ladies on here will be able to, but what does your hubby do in construction? My hubby is also in construction and has quite a few links - could maybe let you know if he hears of anything going?

Are they going to pay all his dues? Was he on limited or unlimited contract? Freezone or not? If he would like legal advice it is worth contacting Ministry of Labour on 800665 - they provide legal advise over the phone too, HTH
