Is my maid entitled to gov't holidays?

Hi ladies!
Since I'm new at having a full time maid, I have yet again another question.
As some of you know, I'm currently in canada to deliver my second baby and have been away from dubai since June with only my husband being home. Our live out maid (full time) has only been coming to the house a few days a week just for a couple of hours to do some basic cleaning and ironing and has had days off in the week and a very 'relaxed' schedule just because of the lack of work. She of course has been getting her full salary every month. My husband is with me in Canada for the passed 2 weeks so she's been going in to the home only 2 twice a week to do some dusting. My mother in law's maid who is muslim has asked for 3 days off for Eid and so my mother in law asked my maid to come by her house to help out as she has some guests. My maid just messaged me, saying how our agreement was that she would get government holidays off which is true. But she hasn't worked full time since she started with us, so when I brought that up with her she told me to deduct 3 days off of her salary as she will not go to my mil's home. I was under the understanding that she is absolutely entitled to her holidays after she has put in the work hours? What would you do in my situation? What is my obligation to her? I don't want to do wrong by anyone :(

sounds like she's been having enough holidays without you being around, public holiday or not, she should show you some appreciation for the freedom she's getting right now and until your back and she's working full time full swing the way you need her and pay her, i don't think she should be compensated for any extra public holidays that happened whilst you were away when she wasn't working full-time anyway. that's just take the Pee in my opinion.

Cleo I think she will be great once you are back and you remember to do with what you are told. This maid really is trouble.

Thanks guys for all of your advice. Kiwispers, I understand what you mean and quite frankly I don't like the idea of her being 'loaned' out either, my MIL doesn't compensate her my husband does and pays her a full and complete salary which is almost triple what many maids make for hardly working. I don't think having her go over there for a few hours for a day is a big deal. We knew it had to have this arrangement while I was in Canada for my delivery and i did tell her so before i left that it was possible that she gets called to go there . Also having her go to my MIL's for a day or two is also one way my husband feels we can ensure she isn't working in other homes while we're not there. Obviously when I'm back in Dubai, loaning her out would be out of the question. I am very new and inexperienced at this so I appreciate everyone's feedback, i'd like to get back to Dubai and see how she is with me around and my two kids before I make any concrete moves about having her visa cancelled :(

But the maid is not refusing to work for the OP, she is refusing to be loaned out to the OPs MIL, which frankly I think is fair enough. I would never expect my maid to work for someone else unless it was a separate agreement between herself and them and they were going to compensate her, she is not property to be loaned and borrowed. Yes, there's foundation in what you have said but there's also goodwill and the idea of you scratch my back and I'll scratch yours - and not just when a persons working hours are practically non existent due to circumstances. This maid has no goodwill to anyone except herself. She knows Cleo is an inexperienced employer. She's trouble with a capital T.

Tell her the holidays don't have to be given on the day of the actual holiday then fix it firmly in your mind that she has to go because if she doesn't you'll soon be calling her madam - cos that really is what she is - your madam. I cant actually believe that you are still entertaining this womans attitude. but isn't that illegal ? OP's MIL is not maids sponsor... Seemingly not as was explained on a previous thread. But that's beside the point really. The maid is a chancer, Cleo is a new employer, the maid knows Cleo doesnt know how to be an employer and is now calling the shots.

I have the same arrangement with my maid. I sponsor her full time, she only comes in a couple of days a week. She does get gov't holidays of, but she wouldn't dream of refusing to come in if I asked her to. That's our deal: she has a lot of free time, but if I need her, she comes in, no questions asked. So honestly, I think I would tell her enough is enough (wasn't she the one who refused to work at your mil's before) and cancel her visa soon as DH is back in Dubai. Not the best of times, with the new baby, but she wants to run the show, which she can't. You will find another maid who will appreciate her freedom.
