Urgent - can someone record conversations without telling you?

To cut a very long story short, a surgery I was meant to have tomorrow has been cancelled because apparently DH was aggressive on the phone to the idiot in the admissions department. He's meant to have sworn at him and threatened him and this little twerp says it's recorded. DH is adamant he didn't do either but I know how frustrating it often is dealing with Dubai bureaucracy and I think there may be a chance he did let something slip but doesn't remember. Any ideas? Thanks.

If you could email me on harpersdxb at gmail dot com, that would be very helpful. Thanks, sami :). I figured the legal advice would follow everything else in Dubai - yes, that's right, until we need it to be wrong :D.

Hi DC Is this with city hospital? I have the email of the medical director and client services person who have been very helpful when i needed to lodge a complaint against their OB. Not sure if they could help but they do take customer service very seriously. Let me know if you would like the contacts.

For future reference, I got a reply from the lawyer this morning saying it's illegal to record a conversation in the UAE without informing the other party/ies that the conversation's being recorded. I'd urge caution with that advice...my experience of UAE lawyers is that for every one that says X another will happily interpret the law as Y. Also that police and courts are often more interested in the result and justice being done than how evidence was gathered, there seems to be a lot of discretion exercised there. Not just in UAE. Everywhere, that's how lawyers make there money. (and I should know, since I am one, not a practicing one I might add, before being slaughtered ;) )

Perhaps if they were less incompetent and argumentative they wouldn't have to put up with it. I've spent most of the day dealing with them and right now I'd rather poke sharp sticks in my eyes than talk to them again. I do see what you mean, though - I remember a friend was hit by a woman in MOE car park and she just drove off, and when the police arrived they were more concerned that this woman alleged my friend swore at her than with the fact that the woman had caused an accident and driven off. It's just been such a saga from start to finish, I think I might be better off finding a new surgeon and hospital. I would agree with your last sentence as I also saw your post about the cost dispute.

I would move on and not get the Police involved. Chalk it up to experience!

That's what I'm worried about. At the moment I have no concrete proof he did use abusive or threatening language and to be honest, I've had enough today and don't need a sniping response on here. I'm looking for advice. Do you know for sure if it's legal to record a conversation if you didn't ask permission? the point I was trying to make is it's immaterial whether it's legal or not, whether your husband was recorded or not, if he swore and made threats to the wrong person. maybe he should call them and apologise? however frustrating it was for him dealing with the bureaucracy, surely it's worse to be sworn at and threatened? I wonder how many times a day they have to put up with that.

It's illegal to record someone without their knowledge- this has been said many times in the news media here, when it's come up in cases. However, as mentioned once it's done then the police would probably listen to it anyway. I don't think there's such a thing as "won't hold up in court"- as we all know people have been done for the 'middle finger' on the say-so of someone else, not even with any video/pics. My company records calls to their HR dept, if you get abusive or use language with the staff you can get in trouble. But they tell us this when we start, it's not actually stated on the phone calls.

DubaiCat, judging by all of our replies, clearly none of us know for sure. Call the police and ask them! They WILL know. I didn't mean you :) and sorry, I should have said thanks for responding - I do appreciate you trying to help. It's been a long and stressful day :(. ETA: I've emailed a lawyer and will call the police in the morning. Then I shall report back for future reference! edited by DubaiCat on 26/03/2012

even if the "twerp" was recording illegally on his mobile phone then the police would still be more interested in your husbands abusive and threatening language if the hospital were to report him.

Well technically, seeing as all the other call centres etc do it, I would say that they have to inform you if they are making a recording, as otherwise you actually have to get police permission to record calls, phone taps etc. But again, this is the UAE, so who knows.

There was no message saying they were recording, no. I want to go in and listen to these supposed recordings but I just need to know if it's legal to record without your knowledge before I do, otherwise I'm worried if he did accidentally swear they might just call the police for the fun of it :(.

Hi DubaiCat, The dentist I use here has a message when you connect saying that the phonecall is recorded,I would think that you have to be made aware of it but who knows what applies here.

Many customer service outlets do record phone calls, normally their message states 'This call may be recorded for customer service satisfaction' or something to that effect. but not always. Be very very careful when dealing with anyone in CS sector here.
