Maid breaking contract ....

Sorry ladies, I tried to post on another thread but there is a heated debate going on so I have made a new thread....

Our maid has also decided she wants to break contract and (I think, checking with hubby as I write!) we have paid for a two year visa that cost us around 10,000aed, she started with us on June 1st last year but the paperwork took an age and her visa didn't start till July ish, she has been with us 10 months and she wants to leave us in July but we have said 'No, you can leave in June thanks' so she will have done a year but visa didn't kick in until July, again like most Mum's posting on this thread I work, so I do need her up until then otherwise I would ask her to go now, fortunately I work for a school so the Summer won't be a problem and I will have time to find another maid. But... what do I owe her then if anything? A one way flight back to the Phillipines? Do I retain a month's salary due to cost of visa and don't pay her flight, am I entitled to do that without getting into trouble? Any advice appreciated. She has played us royally and again like OP, I feel a right nitwit when we have treated her so well.

Also, are there costs involved with cancelling a visa? We haven't sponsored before so any advice much appreciated! TIA.

Thank you Sage & Onion, I shall look into it as I'm put off having a maid for now! I went home last night and found the contract and yes it's only one year, so we aren't therefore going to kick up too much of a fuss as she will have done 11 out of the 12 contracted months. Wicked Angel, thank you for the advice, forgive me as I am so green with this, where do you get your deposit back from, Immigration? We will pay for her one way flight so we know she is on the plane! :) You take her to the airport, they will usually give you a paper or a slip once she exits (I don't remember it was 3 yrs back when we cancelled out maid's visa), you take the slip to the immigration, they deduct a processing fee (around 50-75?) then they will reimburse the remaining amount, but no one can get the money other than her sponsor Eta: make sure to go inside with her to make sure she left :) Sorry I don't trust maids in those issues <em>edited by wickedangel_78 on 01/05/2014</em>

I'm not sure about the cost but it's not much, just filling a form, they will cancel the visa on spot & you get a month after visa cancelation to send her home, once she exits you will get your deposit.

Thanks French Bird, I will check tonight .... We sponsored her but we did it all through Husband's company PRO so I will look when I get in!

Are you sure the visa is for 2 years ? maids visa are usually renewable every year. A 2 year visa is a regular employee visa. This would only be possible if sponsored by your or your husband's company. If she is on a regular employee visa, you will then have to check if it's a limited or unlimited contract. This will tell you if she is entitled to anything. if it is a regular maids visa, then it's only 1 year. You could force her to stay until the end, but it's a case of knowing how much you could trust her caring for your kids.

Thanks! Can't get hold of hubby as he is travelling, so I will have to double check tonight now .... Sorry it was all done via husband's co. so not even seen her contract. :-( Do you know if there are a lot of cost implications for cancelling and how long does it take to process? I just need to find out what she is entitled to if she stay's till June 1st ... TIA. <em>edited by NJP1 on 30/04/2014</em>

There is no maid visa for 2 years for expats, locals get 2 yrs contract I guess but they dont pay a fee unlike expats, is she on a maid's contract or employment contract?
