US Visa for nanny ..... Interview tomorrow.

Hi Ladies,

Can anyone give me any info or advice in advance to prepare my nanny for her interview? Any specific questions they tend to ask or documents which I must give to her?
If anyone can give me any advice then I'd appreciate it.

Hi Natasha - as we understood from the Consulate website its not just minimum wage that you would pay but the 'prevailing wage' for the type of worker which varies for each state. There is a database on some website that gives you the worker classifications and prevailing wages. It's not the easiest thing to figure out - I'm not sure why they make it so difficult. I still have your email address I think, I'll forward you the link for the database a little later along with the information I have on the worker classification. Hi Ladies ... Quick update for all of you going through the process. My nanny went for her interview and said the lady was v nice. Main questions were: is she treated fairly by us, how long she's worked for us, where she'll be staying in US and so on. As others have said, the most important part is having a contract covering her time and wages in USA. I didn't provide my nanny with that so the VISA hasn't been approved yet but she is going back with that document and her passport and has been told she'll get the VISA approved without any problem (tough wood!!!) So basically, make sure your helper has this US contract ..... Megdxb has written a perfect example of one which you could request to see. I'm going to write this contract- does anyone know if the requirement is the US minimum wage ie. 7.67 usd p/h in Florida? Because the VISA interviewer has written that my contract needs to pay 400 USD per wk for 40 hrs which is much higher than minimum wage. Can anyone clarify?

Does your maid work 40 hours/week in Dubai? How many hours/days per week does your helper usually work in Dubai? Could they have asked this at interview and then multiplied it by the minimum wage in that state? It comes out at 52 hours approx

Sorry NatashaK - don't have any advice to add but am watching this thread carefully as I will be doing the same next month and needed to get more info on applying for my helper's visa. Please let us know how you/she gets on and what kind of information/questions they ask. I was hoping to book the tickets etc AFTER she gets her visa in case it is denied for whatever reason but I guess it needs to be done before hand?

The main thing that the consulate will be concerned with is is whether the nanny understands that she is meant to be paid the US minimum wage regardless of what her salary is in Dubai and he would want to make sure that she will come back .

Desertdoc and anyone else .... The times you successfully got the visa for the nanny was it a visit visa and did you tell them she was working as a nanny whilst travelling?

Our nanny had come with us to the US several times and obviously hadn't absconded. The last time we went to get a visa for her, it was 7 months since her last one expired. And we had an absolute cow of a woman at the US Embassy in AD. I was literally in tears, the way she spoke to our nanny. The lady asked my nanny (in private) who would be keeping her passport while she was in the States and my nanny said I would - thinking that was the correct answer. I do hold her passport when we travel in the way I hold my husband's and ALL of my children's passports. This lady then called me over, banged her file shut and said the interview was over since I would keep the nanny's passport. I tried to explain that in my home in Dubai, I keep all passports on an open shelf that she can take anytime. The reason I keep it is because she lost it once on the beach along with her labour card etc and it was a nightmare getting everything replaced. So now, she keeps a photocopy of everything in her wallet when she is out but the original is there for her to take if she wants it.

Lastly, can anyone confirm something for me. On a previous thread regarding the same thing someone wrote that if we are all on visit visas which we will be and presumably my nanny will be then she cannot work for us in the US under any circumstances so we need to say that she is on a vacation with us. Did any of you successfully get the VISA for the nanny as a nanny who will be working out there but you're not US citizens or residents? Or we're you all on Visit Visas? We are from UK and have no ties in the US other than we have a holiday home there which we travel to frequently. Any advice?

Yes, we wrote a letter explaining why we were travelling to the US and that we wanted her to accompany us and confirming that we would cover all her expenses and any emergencies during the trip. We gave the period of her employment with us and also the length of time she had been working in the UAE in total. We took out travel insurance for her for the period of the trip and brought the Insurance certificate with us. We gave details of previous trips she had done with us and included photocopies of visas for those trips. We gave copies of all our families passports and copies of our UAE residency visas. We had our tickets booked and paid for, and we gave copies of those Including the kids tickets, we gave details of where we were staying and all the relevant hotel bookings. She didn't bring any personal photos, we did bring her marriage certificate, but I don't think they even asked to see it. We certainly didn't plan on paying ours minimum wage in the US either, and she earns less than your lady does, as I said, it was never brought up in the interview. Would be interested to hear if they do question her on that, would you mind letting me know, as we would like to possibly travel to the US next year again with our helper. Thanks for the replies ladies. She will be coming with us during our 6 week vacation and I wasn't planning on paying her US minimum wages. She gets 3500 aed which is sufficient. But if they ask her that question should I tell her to say she will be getting the US minimum wage??? Did you write a letter inviting your nanny to the US? Did you book your tickets first and show the exact travel dates? Did you take any additional documents or evidence? Like pictures of nanny and her family in Sri Lanka? Or birth certificates? Any extra info for me ladies?? Thanks!

In our case, the salary during her stay in the US was never brought up at all. But we were looking for a short term visa, it's probably different if she will be moving to the US permanently with you or for several months. It was more about trying to establish if there was a risk of her absconding while there. They spoke to her about her family back home, how many people she supports, does she have kids and husband back in the Philippines, how often does she go home and for how long. Same questions posed in different ways. How long she has worked for you, how long in the UAE, has she been to US or elsewhere previously. I guess the approach to the interview will depend on the type of visa she is applying for. Good Luck. <em>edited by mum2girls on 09/10/2012</em>

H Natasha - the main thing that the consulate may ask her (in my experience) is whether she understands that she is meant to be paid the US minimum wage in whichever state you are visiting for the time that you are there, regardless of what her salary is in Dubai. They tend to ask her this in private and NOT in front of you, given the number of cases that have been reported in media about people exploiting their helpers in the US. So you may want to read up on minimum wage and discuss with her in advance. You also want to make it clear that she will be coming back to the UAE with you and doesn't have any intention of staying in the US.
