Rental problem!!!

My friend rented an apartment in Fox Hill 2 weeks ago.
He paid everything and was told by Betterhomes that the contract and the key will come in 1 week.
Now after two weeks.....nothing.
Betterhomes saying the owner is sick, he cant sign and we cant go to his house as he is VIP.
What are my friends rights....as he allready had to leave his old apartment, living out of a suitcase now.
Need to buy furniture which he cant as he cant put it in the house.

Sorry to hear what happened to your friend. Just to clarify, at which point should I hand over deposit and agency fee? Deposit with contract and keys, or is signed contract sufficient? I am not sure I want to pay the agency fee until everything is in order and I have viewed the property at the very least, but I wonder what everyone's experience is? I've always paid the deposit when I want to hold the property. Then get cheques together, and upon receipt of signed contract, countersign it and take keys / hand over agency fee and cheques.

This what happened here, deposit and agent fee paid to secure the place. Then 4 cheques....all more then 2 weeks ago. One cheque cashed.....no contract....and key today. But not possible to do anything more then put some suitcases. So be careful what you pay!

Interesting... We also happen to be looking for a place and found something. The agent (from BH) is keen to receive the deposit and agency fee to 'secure' the place. Only then will the contract be issued. Is this standard practise? Am I right in insisting we should only pay if both signed contract and keys are exchanged at the same time?

Well then the whole story became more funny today! At the moment my friend walked in my house a lady from Betterhomes called him. Asking if he had any problems and if he has been helped good. Saying that now the owner is in hospital. And maybe before the weekend he get the signed contract. And if the guy ( agent) he deals with from Betterhomes was doing his job ok and inform him proper enough. So he told her yes as he got the feeling she wanted to put him in a bad light and I just told him the comments on here. So we were thinking this was the same person. We also came to the conclusion that they cashed the first cheque!! So they can't sign but know how to run to the bank! So yes tomorrow legal action! <em>edited by Belinda on 06/11/2012</em>

As I mentioned there is always 2 sides to a story. Better Homes has assisted me extremely professionally when I leased out my property as well as purchased another property. If you had concerns then there is a Manager of that agent as well as a Head of Department who I am sure would be very accommodating. I would highly recommend Better Homes but each to their own.

Wow Netts, I guess you know the tenant and spoke with him! As you seem to clearly know he has no issue! For the others who were helpful, after 3 hrs of fighting with Betterhomes, he got the key today however still no contract but they say it will come! At least he can move the stuff from the car in and start buying furniture. I guess he learned a lesson as well! Never pay the commission before the contract and key.

Dear All, There is always 2 sides to a story and the truth is never revealed on such forums. The tenant is well aware of the situation and has no issue. If he does he would have contacted Management or even the director of Better Homes, where in this case this has not at all happened.

They say the contract is at the guys offices and because he is a VIP they cannot push him or go to his home to sign? Lame excuse!! Your friend should go to better homes and insist, not over the phone. If they don't react immediately, same day should go to Rent Committee. As in immediately!

Something is definitely not right about this, even if someone is ill they can still sign the contract. I'd check what cheques Betterhomes have cashed and as others have said, get in touch with RERA asap. Betterhomes are usually much more professional than this. Please don't send her to RERA, is Rent Committee that deals with these issues!!

As I always mentioned here: the body that is in charge of disputes between landlords and tenants is RENT COMMITTEE, not RERA (which is the Reagulatory Agency for Real Estate as the name says!!). Your friend should tell BH that he will address the issue to the Rent Committee. Hope he has copies of the cheques he handed out. He should put this together with his bank statement that deposit and agency fee has been paid and, if BH doesn't react, he should go to Rent Committee asap!

It's empty! Well it's the first time he rent via an agent and they told him to pay to secure the flat and the contract ready in 4 to 5 days. He knew he had to leave his flat so he really wanted it. I feel too bad for him as I was the one told him to have a look at it :-(

Does he have receipts from Betterhomes indicating the date when he paid the deposit? This is very unprofessional on behalf of Betterhomes. Is the flat he rented currently empty or occupied? Really, I can't believe that your friend has paid everything without having the LL sign the contract....... Betterhomes should have managed this much better

I wouldnt give them any cheques until i got the keys
